• Hình thức cung cấp dịch vụ thông tin đất đai
Việc cung cấp dịch vụ thông tin đất đai từ hồ sơ địa chính cho đối tượng là cá nhân khai thác được thực hiện dưới các hình thức sau:
- Tra cứu thông tin;
- Trích lục bản đồ địa chính đối với từng thửa đất;
- Trích sao Sổ địa chính, Sổ mục kê đất đai đối với từng thửa đất hoặc từng chủ sử dụng đất;
- Tổng hợp thông tin đất đai;
• Thẩm quyền cung cấp thông tin
Văn phòng đăng ký quyền sử dụng đất thuộc Phòng Tài nguyên và Môi trường cung cấp thông tin đất đai của địa phương dưới các hình thức: Tra cứu thông tin; Trích lục bản đồ địa chính đối với từng thửa đất; Trích sao Sổ địa chính, Sổ mục kê đất đai đối với từng thửa đất hoặc từng chủ sử dụng đất; Tổng hợp thông tin đất đai (trừ các thông tin thuộc danh mục bí mật nhà nước không được phép công bố).
Uỷ ba nhân dân cấp xã cung cấp thông tin đất đai của địa phương dưới hình thức tra cứu thông tin (trừ các thông tin thuộc danh mục bí mật nhà nước không được phép công bố).
Cơ quan cung cấp thông tin phải chịu trách nhiệm đối với nội dung thông tin đã cung cấp và phải xác nhận bằng văn bản về độ tin cậy của nội dung thông tin khi người sử dụng thông tin có yêu cầu.
• Thủ tục cung cấp thông tin
Người có yêu cầu cung cấp thông tin phải nộp phiếu yêu cầu đến Văn phòng đăng ký quyền sử dụng đất hoặc Uỷ ban nhân dân cấp xã theo quy định sau:
Trường hợp yêu cầu cung cấp thông tin dưới hình thức tra cứu, trích lục bản đồ địa chính, trích sao Sổ địa chính, Sổ mục kê đất đai thì phải có phiếu yêu cầu thông tin theo Mẫu số 01/TTĐĐ ban hành kèm theo Thông tư này. Nội dung chính của Phiếu yêu cầu cung cấp thông tin gồm:
- Tên cơ quan giải quyết yêu cầu cung cấp thông tin;
- Họ tên người yêu cầu cung cấp thông tin;
- Địa chỉ thường trú.
- Nội dung thông tin yêu cầu cung cấp.
- Phương thức nhận kết quả (nhận trực tiếp tại cơ quan cung cấp thông tin hoặc gửi qua bưu điện):
- Thời điểm nhận kết quả.
- Người yêu cầu cung cấp thông tin ký và ghi rõ họ tên.
Trường hợp yêu cầu tra cứu thông tin thì gửi Phiếu yêu cầu đến Uỷ ban nhân dân cấp xã, Uỷ ban nhân dân xã cung cấp ngay trong ngày nhận được phiếu yêu cầu;
Trường hợp yêu cầu cấp trích lục bản đồ địa chính, trích sao hồ sơ địa chính thì gửi Phiếu yêu cầu đến Văn phòng đăng ký quyền sử dụng đất cấp huyện, Văn phòng cung cấp thông tin trong thời hạn không quá 2 ngày làm việc kể từ ngày nhận được phiếu yêu cầu.
Người được cung cấp thông tin đất đai phải trả tiền sử dụng thông tin và tiền dịch vụ cung cấp thông tin theo quy định về giá tiền sử dụng thông tin và tiền dịch vụ cung cấp thông tin đất đai do Hội đồng nhân dân cấp tỉnh ban hành.
