Các Bên nhận thực rằng trong quá trình đàm phán, thực hiện Hợp đồng này được tính kể từ ngày Hợp đồng này hết hiệu lực thì Các Bên có nghĩa vụ phải giữ các bí mật tất cả các thông tin mà Bên kia cung cấp và không cung cấp, tiết lộ hay trao đổi dưới bất kỳ hình thức nào cho bên thứ ba, từ những thông tin được yêu cầu cung cấp cho các cơ quan chính quyền hoặc giới chức theo luật định. Trường hợp này Bên cung cấp thông tin phải thông báo cho Bên kia biết trước tối thiểu 02 ngày làm việc.
Trong trường hợp một Bên vi phạm việc bảo mật thông tin theo thỏa thuận tại Điều này dẫn đến gây thiệt hại cho Bên kia thì Bên bị vi phạm có quyền yêu cầu bồi thường thiệt hại theo quy định pháp luật hiện hành.
