Một chế độ mà không nhiều doanh nghiệp và người lao động quan tâm đến là chế độ khi con ốm đau. Thông tư 59/2015/TT-BLĐTXH đã hướng dẫn chi tiết cách tính thời gian hưởng và mức hưởng chế độ này. Kể từ ngày 01/01/2016, mức hưởng chế độ ốm đau và chế độ khi con ốm đau sẽ cao hơn do thay đổi công thức tính: tiền lương ngày làm căn cứ mức hưởng là lương tháng chia (:) cho 24 ngày (chứ không phải 26 ngày như hiện nay).
