Mặc dù đã rất nỗ lực với tinh thần hợp tác cao, nhưng đến nay Nhà thầu đã không thể triển khai thi công được các hạng mục công trình theo tổ chức biện pháp thi công, tiến độ và hồ sơ thiết kế đã trình nộp và được phê duyệt theo điều khoản 8.3 [Chương trình] của Hợp đồng. Bên cạnh đó, nếu phải tổ chức thi công với điều kiện mặt bằng được bàn giao như hiện nay, Nhà thầu khẳng định rằng tổ chức biện pháp thi công, tiến độ và hồ sơ thiết kế sẽ cần phải thay đổi, trình nộp và phải được sự phê duyệt lại từ phía Tư vấn giám sát và Chủ đầu tư làm cơ sở thực hiện. Việc làm này sẽ ảnh hưởng tới tiến độ thi công tổng thể của Dự án cũng như ảnh hưởng tới chi phí, dòng tiền của Nhà thầu
