Hiến pháp nước Cộng hòa xã hội chủ nghĩa(XHCN) Việt Nam đã được Quốc hội (khóa XIII), Kỳ họp thứ sáu thông qua ngày 28-11-2013, có hiệu lực từ ngày 01-01-2014. Đây là sự kiện quan trọng, nổi bật trong đời sống chính trị của nhân dân ta. Bản Hiến pháp năm 2013 là kết tinh trí tuệ và sức mạnh đại đoàn kết toàn dân tộc, thực sự thể hiện được lợi ích, quyền lực, ý chí của toàn dân đối với chính thể dân chủ, Nhà nước và chế độ XHCN do mình góp sức xây dựng và làm chủ. Trong đó, Điều 4, Chương I (về chế độ chính trị) của Hiến pháp đã hiến định vai trò của Đảng, khẳng định địa vị pháp lý của Đảng chính trị cầm quyền, đảm nhận trọng trách lịch sử mà dân tộc và nhân dân giao phó - đó là Đảng Cộng sản (ĐCS) Việt Nam - lực lượng lãnh đạo Nhà nước và xã hội.
