16.8. Các quy định khác:
16.8.1. Doanh nghiệp dự án có nghĩa vụ tạo điều kiện cho [Bbb] tổ chức giám định Công trình dự án. Doanh nghiệp dự án hợp tác và tạo điều kiện thuận lợi cho [Bbb] hoặc đơn vị do [Bbb] ủy quyền hoặc tổ chức khác được chính phủ chỉ định tiếp nhận trong việc tiếp nhận bàn giao Công trình dự án và các hạng mục cần chuyển giao theo quy định tại Hợp đồng BOT này và tuân thủ các quy định hiện hành của nhà nước.
16.8.2. Doanh nghiệp dự án chủ trì lập hồ sơ bàn giao Công trình dự án làm căn cứ pháp lý cho việc chuyển giao Công trình dự án.
16.8.3. Khi chuyển giao Công trình dự án hai bên tiến hành xem xét các điều kiện chuyển giao Công trình dự án, bao gồm các nội dung sau đây:
a. Tình trạng của Công trình dự án khi chuyển giao phải bảo đảm đáp ứng các yêu cầu theo quy định của Hợp đồng BOT này.
b. Danh mục các tài sản chuyển giao bao gồm: các tài liệu liên quan đến khảo sát, thiết kế, hồ sơ hoàn thành, các tài liệu liên quan tới vận hành, bảo trì Công trình dự án.
c. Văn bản giám định chất lượng của [Bbb] đối với Công trình dự án được chuyển giao.
d. Trách nhiệm của các bên đối với việc tiếp tục vận hành Công trình dự án được chuyển giao.
e. Các hợp đồng có liên quan và điều kiện cần thiết khác để duy trì, vận hành Công trình dự án (nếu có).

B. The list of assets transferred include documents relating to surveying, design, complete records and documents related to the operation and maintenance of the project works.
C. The written assessment of the quality of [Bbb] for project work is transferred.
D. Responsibilities of the parties for the continued operation of the project work is transferred.
E. The relevant contracts and other necessary conditions for the maintenance and operation of the project work (if any).
