Trong Hợp đồng này, các từ được viết hoa sẽ có nghĩa như được quy định dưới đây, trừ khi ngữ
cảnh quy định khác đi.
"Ban Quản trị" : nghĩa là một tổ chức do Hội nghị nhà chung cư bầu ra, bao gồm đại
diện các Chủ sở hữu và đại diện Chủ Đầu tư hoặc Doanh nghiệp
quản lý Khu Chung cư. Thành viên của Ban Quản trị tạm thời trong
02 (hai) năm đầu tiên kể từ ngày Bên bán tiến hành bàn giao thực tế
Căn hộ cho Bên mua sẽ do Bên bán đề cử;
“Bản Nội quy ” : nghĩa là bản nội quy quản lý sử dụng Khu Chung cư có nội dung và
hình thức được đính kèm tại Phụ lục 06 của Hợp đồng này. Bên
mua đồng ý rằng (i) Bản nội quy này có thể được sửa đổi bởi Chủ
Đầu tư trong thời gian Ban Quản trị chưa được thành lập hoặc Ban
Quản trị sau khi Ban Quản trị được thành lập và (ii) Bản nội quy
được sửa đổi như vậy sẽ áp dụng đối với tất cả các Bên mua và
người thuê Căn hộ khác và Bên mua sẽ nhận được một thông báo
về việc sửa đổi này;
“ Căn hộ ” nghĩa là Căn hộ với những đặc điểm nêu tại Điều 2 của Hợp đồng
này;
“Diện tích sử dụng
căn hộ”
là diện tích sử dụng riêng của căn hộ được tính theo kích thước
thông thủy và được ghi vào Giấy chứng nhận cấp cho người mua,
bao gồm cả phần diện tích tường ngăn các phòng bên trong căn hộ
và diện tích ban công, lô gia (nếu có) gắn liền với căn hộ đó; không
tính tường bao ngôi nhà, tường phân chia các căn hộ và diện tích
sàn có cột, hộp kỹ thuật nằm bên trong căn hộ. Khi tính diện tích
ban công thì tính toàn bộ diện tích sàn, trường hợp ban công có
phần diện tích tường chung thì tính từ mép trong của tường chung
được thể hiện rõ trong bản vẽ thiết kế mặt bằng căn hộ đã được phê
duyệt;
“ Diện tích sàn xây

là diện tích được tính từ tim tường bao, tường ngăn căn hộ, bao
gồm cả diện tích sàn có cột, hộp kỹ thuật nằm bên trong căn hộ;
“Chủ Đầu tư ” là Công ty Cổ phần Địa ốc Sài Gòn Thương Tín;
“Chủ sở hữu” : nghĩa là Bên mua hoặc tổ chức, cá nhân nào sở hữu hợp pháp Căn
hộ hay phần diện tích bất kỳ khác thuộc Tòa nhà, Khu Chung cư,
Khu Dân cư, tuy nhiên với điều kiện là trong trường hợp Căn hộ
thuộc (i) sở hữu chung của vợ và chồng hoặc từ hai cá nhân trở lên
hoặc (ii) quyền sở hữu của một công ty hoặc tổ chức, Chủ sở hữu sẽ
là một cá nhân cụ thể do các chủ sở hữu chung hoặc công ty, tổ
