Yêu cầu về bảo hành:
- Hình thức bảo hành: Bằng bảo lãnh của một ngân hàng hoạt động hợp pháp theo mẫu có nội dung được chủ đầu thư chấp thuận.
- Thời hạn bảo hành: Thời hạn bảo hành là 12 tháng kể từ ngày hàng hóa được nghiệm thu đưa vào sử dụng;
- Giá trị bảo hành: Bằng 5% giá hợp đồng trước thuế GTGT
- Hiệu lực của bảo đảm bảo hành bằng thời gian bảo hành cộng thêm 30 ngày;
- Cơ chế giải quyết các hư hỏng, khuyết tật phát sinh trong quá trình sử dụng hàng hóa trong thời hạn bảo hành:
+ Khi hàng hoá bị hư hỏng do lỗi của nhà sản xuất hoặc lỗi của nhà thầu, chủ đầu tư thông báo cho nhà thầu, trong vòng 20 ngày kể từ khi nhận được thông báo nhà thầu phải khắc phục hư hỏng đó, chi phí cho việc khắc phục hư hỏng đó nhà thầu chịu.
+ Nếu nhà thầu không thực hiện trong thời gian qui định trên chủ đầu tư sẽ tiến hành khắc phục, mọi chi phí nhà thầu chịu.
+ Trong trường hợp phải sửa chữa, thay mới thì thời gian bảo hành là 12 tháng được tính kể từ khi sửa chữa thay mới.
