Mục 7. THỰC HIỆN NGHĨA VỤ THANH TOÁN CỦA NGƯỜI BẢO LÃNH
Điều 38. Nguyên tắc thực hiện nghĩa vụ của Người bảo lãnh
1. Bộ Tài chính thực hiện nghĩa vụ thanh toán của người bảo lãnh phát sinh theo Thư bảo lãnh khi người được bảo lãnh không trả được nợ và bị người cho vay đòi theo Thư bảo lãnh.
2. Nguồn để Bộ Tài chính thực hiện nghĩa vụ thanh toán là từ Quỹ Tích lũy trả nợ. Trường hợp Quỹ Tích lũy trả nợ không đủ nguồn, Ngân sách Nhà nước có trách nhiệm bố trí nguồn để thực hiện nghĩa vụ thanh toán.
3. Trường hợp người được bảo lãnh mất khả năng thanh toán và sau khi xử lý tài sản bảo đảm (nếu có) mà vẫn không đủ nguồn bù đắp cho Quỹ Tích lũy trả nợ, Quỹ Tích lũy trả nợ hạch toán giảm nguồn đối với phần không thể thu hồi.

3. Where the sponsor is not able to pay and after handling security assets (if any) but still not enough to offset the cumulative debt funds, fund accounting cumulative debt reduction to share resources Irrevocable.
