Điều 159. Đối tượng được sở hữu nhà ở và hình thức sở hữu nhà ở tại Việt Nam của tổ chức, cá nhân nước ngoài
1. Đối tượng tổ chức, cá nhân nước ngoài được sở hữu nhà ở tại Việt Nam bao gồm:
a) Tổ chức, cá nhân nước ngoài đầu tư xây dựng nhà ở theo dự án tại Việt Nam theo quy định của Luật này và pháp luật có liên quan;
b) Doanh nghiệp có vốn đầu tư nước ngoài, chi nhánh, văn phòng đại diện của doanh nghiệp nước ngoài, quỹ đầu tư nước ngoài và chi nhánh ngân hàng nước ngoài đang hoạt động tại Việt Nam (sau đây gọi chung là tổ chức nước ngoài);
c) Cá nhân nước ngoài được phép nhập cảnh vào Việt Nam.
2. Tổ chức, cá nhân nước ngoài được sở hữu nhà ở tại Việt Nam thông qua các hình thức sau đây:
a) Đầu tư xây dựng nhà ở theo dự án tại Việt Nam theo quy định của Luật này và pháp luật có liên quan;
b) Mua, thuê mua, nhận tặng cho, nhận thừa kế nhà ở thương mại bao gồm căn hộ chung cư và nhà ở riêng lẻ trong dự án đầu tư xây dựng nhà ở, trừ khu vực bảo đảm quốc phòng, an ninh theo quy định của Chính phủ.

1. Subjects organizations, foreign individuals to own houses in Vietnam include:
a) Organizations and individuals investing overseas housing construction project in Vietnam under the provisions of this law and the law relevant;
b) Enterprises with foreign investment, branch and representative offices of foreign enterprises, foreign investment funds and foreign bank branches operating in Vietnam (hereinafter referred generally foreign institutions);
c) Foreign citizens are allowed to enter Vietnam.
2. Organizations and individuals to own houses in Vietnam through the following forms:
a) Investment in housing construction project in Vietnam under the provisions of this Law and related legislation;
b) Purchasing, leasing, donation or inheritance of commercial housing includes apartments and individual houses in investment projects of housing construction, except for the area to ensure defense and security in accordance Government regulations.
