II. Cơ sở pháp lý

Trong 11 năm qua, kể từ sau ngày Thủ tướng Chính phủ ban hành Quyết định số 95/2003/QĐ-TTg; Nhà nước đã ban hành một số văn bản, chính sách có liên quan đến việc xây dựng và thúc đẩy phát triển công nghệ cao và các cơ chế ưu đãi đối với các Khu Công nghệ cao, đó là:

1. Về đầu tư – xây dựng:

- Luật về Xây dựng (Số 16/2003/QH11 ngày 26/11/2003);

- Luật Đấu thầu (Số 61/2005/QH11 ngày 29/11/2005);

- Luật Đất đai (Số 13/2003/QH11 ngày 26/11/2003) và Nghị định số 181/2004/NĐ-CP ngày 29/10/2004 của Chính phủ về thi hành Luật Đất đai;

- Luật Nhà ở (Số 56/2005/QH11 ngày 29/11/2005) và Nghị định số 71/2010/NĐ-CP ngày 23/6/2010 của Chính phủ về hướng dẫn thi hành Luật Nhà ở;

- Luật Bảo vệ môi trường (Số 52/2005/QH11 ngày 29/11/2005);

- Luật Sửa đổi, bổ sung một số điều của các Luật liên quan đến đầu tư xây dựng cơ bản (Số 38/2009/QH12 ngày 19/6/2009);

- Luật Quy hoạch đô thị số 30/2009/QH12 được Quốc hội thông qua ngày
17/6/2009.

- Nghị định số 41/2007/NĐ-CP ngày 22/3/2007 của Chính phủ về xây dựng ngầm
đô thị;

- Nghị định số 12/2009/NĐ-CP ngày 12/02/2009 của Chính phủ về Quản lý dự án đầu tư xây dựng công trình và Nghị định số 83/2009/NĐ-CP ngày 15/10/2009 của Chính phủ về sửa đổi, bổ sung một số điều của Nghị định số 12/2009/NĐ-CP ngày 12/02/2009;

- Nghị định số 85/2009/NĐ-CP ngày 15/10/2009 của Chính phủ về việc hướng dẫn thi hành Luật đấu thầu và lựa chọn nhà thầu xây dựng theo Luật Xây dựng và Nghị định số 68/2012/NĐ-CP ngày 12/9/2012 của Chính phủ sửa đổi, bổ sung một số điều của Nghị định số 85/2009/NĐ-CP;

- Nghị định số 108/2009/NĐ-CP ngày 27/11/2009 của Chính phủ về đầu tư theo hình thức Hợp đồng Xây dựng – Kinh doanh – Chuyển giao, Hợp đồng Xây dựng – Chuyển giao – Kinh doanh, Hợp đồng Xây dựng – Chuyển giao;

- Nghị định số 24/2011/NĐ-CP ngày 05/4/2011 của Chính phủ về sửa đổi, bổ sung một số điều của Nghị định số 108/2009/NĐ-CP ngày 27/11/2009 của Chính phủ và Thông tư số 03/2011/TT-BKHĐT ngày 27/01/2011 của Bộ Kế hoạch và Đầu tư về hướng dẫn thực hiện một số quy định của Nghị định số 108/2009/NĐ-CP ngày 27/11/2009 của Chính phủ về đầu tư theo hình thức Hợp đồng Xây dựng – Kinh doanh – Chuyển giao, Hợp đồng Xây dựng – Chuyển giao – Kinh doanh, Hợp đồng Xây dựng – Chuyển giao;

- Nghị định số 99/2003/NĐ-CP ngày 28/8/2003 của Chính phủ về Quy chế Khu công nghệ cao;
