Theo quy định của nghị định số 135/2016/NĐ-CP của chính phủ sửa đổi, bổ sung một số điều của Nghị định số 45/2014/NĐ-CP của Chính phủ quy định về thu tiền sử dụng đất và Nghị định số 46/2014/NĐ-CP của Chính phủ quy định về thu tiền thuê đất, thuê mặt nước có hiệu lực từ ngày 15/11/2016 thì Mekong Auto sẽ bị ảnh hưởng bởi nghị định này đối với các miếng đất sau đây:
- Đất có diện tích 17.000 m2 tại Bình Tân do Mekong Auto thuê của nhà nước từ 22/6/2001 đến hết ngày 22/6/2021
- Đất có diện tích 980m2 đất tại Trần Hưng Đạo do Mekong Auto thuê của nhà nước từ 22/6/2011 đến hết ngày 22/6/2021.
Tuy nhiên, những nội dung hướng dẫn trong nghị định số 135/2016/NĐ-CP chỉ là những nội dung khái quát.
Dự kiến trong vòng 6 tháng sau khi nghị định số 135/2016/NĐ-CP có hiệu lực, Bộ tài chính sẽ ban hành thông tư để hướng dẫn cụ thể nghị định này. Chúng tôi sẽ tiếp tục theo dõi, cập nhật và thông báo cho ông ngay sau khi ban hành thông tư này.
Riêng diện tích đất 11.000m2 Mekong Auto thuê của Sakyno: Đây là diện tích đất có nguồn gốc do Sakyno thuê trực tiếp của nhà nước. Vì vậy, việc thực hiện nghĩa vụ đóng tiền thuê đất với nhà nước là việc giữa nhà nước với Sakyno. Mekong Auto không chịu sự điều chỉnh của nghị định trên.
