Hình phạt tử hình do Nhà nước áp dụng đối với người phạm tội đặc biệt nghiêm trọng để loại trừ vĩnh viễn người đó ra khỏi đời sống xã hội. Phạm tội đặc biệt nghiêm trọng được quy định rõ trong khoản 3 điều 8 chương 3 của bộ luật hình sự Việt Nam
