Cụ thể, đại diện của lao động là công đoàn cơ sở. Khi chưa thành lập công đoàn, đại diện của lao động nữ là công đoàn cấp trên trực tiếp cơ sở nếu tập thể lao động nữ có yêu cầu. Trường hợp không có yêu cầu thì người sử dụng lao động lấy ý kiến của trên 50% lao động nữ tại doanh nghiệp.
