12.5. Quản lý tiến độ xây dựng Công trình dự án
12.5.1. Thời gian xây dựng Công trình dự án: Dự kiến khởi công Quý I/2016, hoàn thành cuối năm 2018. Doanh nghiệp dự án lập tiến độ thi công chi tiết trình [Bbb] theo quy định tại Khoản 12.5.5 Hợp đồng BOT này.
12.5.2. Doanh nghiệp dự án có nghĩa vụ triển khai thi công xây dựng Công trình dự án theo đúng thỏa thuận trong Hợp đồng BOT này. Kế hoạch thực hiện các gói thầu dự kiến được trình bày tại Phụ lục 3 của Hợp đồng BOT này.
12.5.3. Thời gian (tiến độ) thi công xây dựng Công trình dự án được điều chỉnh trong các trường hợp sau:
a. Do ảnh hưởng của động đất, bão, lũ lụt, sóng thần, hỏa hoạn hoặc sự kiện bất khả kháng khác theo quy định tại Điều 22 Hợp đồng BOT này;
b. Do [Bbb] chấp nhận, thỏa thuận, thống nhất hoặc do các yêu cầu về các nội dung: Thay đổi nội dung cơ bản của Dự án và thay đổi Thiết kế cơ sở của Dự án mà cần bổ sung thời gian để lập, thẩm định, phê duyệt điều chỉnh Dự án, điều chỉnh Thiết kế bản vẽ thi công.
c. Trong thời gian thi công Dự án xảy ra hiện tượng khan hiếm VLXD, Nhà đầu tư và Nhà thầu cần thời gian để khắc phục đối với trường hợp:
(i) Nhà nước tập trung nguồn lực để thực hiện nhiệm vụ quốc phòng, an ninh, phòng chống lũ lụt.
(ii) Nhà nước đột ngột cấm khai thác các nguồn, mỏ vật liệu xây dựng, cấm sử dụng các loại vật liệu xây dựng đã quy định trong Dự án, khu vực xây dựng Dự án làm ảnh hưởng đến nguồn cung ứng thực hiện Dự án;
(iii) Nhà nước thay đổi, ngăn cấm nhập khẩu các vật tư, vật liệu xây dựng sử dụng trong Dự án mà trong nước không sản xuất được; do đó Nhà đầu tư, Doanh nghiệp dự án cần phải có thời gian để tìm nguồn vật tư, vật liệu thay thế.
d. Do Chủ đầu tư Dự án thành phần giải phóng mặt bằng và tái định cư bàn giao mặt bằng chậm so với kế hoạch dự kiến trong Hợp đồng hoặc không bàn giao mặt bằng để thực hiện Dự án.
e. Trường hợp bàn giao mặt bằng chậm do lỗi của Nhà đầu tư, Doanh nghiệp dự án thì không được điều chỉnh thời gian thi công xây dựng Dự án.
f. Các trường hợp khó khăn đặc biệt làm cho Nhà đầu tư, Doanh nghiệp dự án dù cố gắng hết khả năng nhưng cũng vẫn phải cần thêm thời gian để thi công xây dựng Công trình dự án, bao gồm:
(i) Nhà nước trưng thu, trưng dụng Dự án, tài sản, thiết bị trong một thời gian nhất định phục vụ cho nhiệm vụ quốc phòng, an ninh, hộ đê hoặc sự kiện đặc biệt khác;
(ii) Dừng thi công để tạm sử dụng công trình cho các mục đích khác trong một thời gian nhất định theo yêu cầu, quyết định của [Bbb];
(iii) Các trường hợp khách quan, đặc biệt, hợp lý khác được [Bbb] chấp nhận;
g. Thủ tướng Chính phủ, các Bộ có thẩm quyền hoặc [Bbb] yêu cầu tạm dừng, ngừng, giãn, hoãn tiến độ thực hiện Dự án có thời hạn hoặc không thời hạn.
