Sau khi xem xét hồ sơ tài liệu công ty Lixil gửi, Chúng tôi nhận thấy các tài liệu về mua hàng đã đủ căn cứ chứng minh quyền sở hữu đầy đủ của Lixil với chiếc xe tải đã cho Cường Lâm thuê.
Do đó, có đủ cơ sở để khẳng định chiếc xe này là xe tải này là thuộc sở hữu của Lixil.
Quan điểm của Cường Lâm cho rằng Lixil đã cho Cường Lâm chiếc xe này để sử dụng nhưng chưa xuất trình được các chứng cớ, tài liệu cần thiết chứng minh cho luận điểm này.
Trong khi đó, hai bên đã ký kết hợp đồng thuê xe tải. Dựa trên nội dung của hợp đồng này, Lixil có toàn quyền sở hữu và có quyền yêu cầu Cường Lâm trả lại xe tải đã được cho thuê.
Tới thời điểm hiện tại, Lixil đã gửi CV yêu cầu nhưng phía Cường Lâm chỉ đồng ý trả với điều kiện phía Lixil có nghĩa vụ thanh toán chi phí sửa chữa, bảo dưỡng trong tháng 8/2015 là 33.340.000 VNĐ. Yêu cầu nêu trên là không có cơ sở, trong khi căn cứ theo hợp đồng thuê được ký giữa hai bên, Cường Lâm đồng ý thanh toán toàn bộ các chi phí duy trì, bảo dưỡng và những chi phí liên quan khác từ hoạt động thường ngày.

1. Lixil ủy quyền cho ATS gửi thư yêu cầu trả xe dưới tên ATS với tư cách người được Lixil ủy quyền;
2. Lixil ủy quyền cho ATS thay mặt Lixil trao đổi, đàm phán với phía Cường Lâm về nội dung yêu cầu trả lại xe tải đã thuê;
3. Tiến hành các thủ tục pháp lý cần thiết để khởi kiện Cường Lâm yêu cầu trả lại xe tải đã thuê.
