5 đặc trưng của tội phạm có tổ chức ở Việt Nam

Các băng tội phạm có tổ chức đã phát triển ở mức cao hơn so với loại tội phạm đơn giản mang tính truyền thống nặng về sử dụng bạo lực. Chúng tạo vỏ bọc hợp pháp, gây án một cách kín đáo với nhiều hình thức che đậy rất khôn khéo.



Theo Bộ Công an có 5 đặc trưng cơ bản của tội phạm có tổ chức ở Việt Nam:

1. Là một tổ chức bí mật, khép kín, bất hợp pháp (có thể núp dưới danh nghĩa một tổ chức hợp pháp) được hình thành với mục đích là phạm tội. Tổ chức hoạt động rõ ràng, chặt chẽ, có tên cầm đầu, chỉ huy, có kỷ luật riêng được quy ước bằng miệng hoặc bằng văn bản.

2. Có số lượng người phạm tội đông, đã được thử thách và được tuyển lựa trong quá trình thực hiện tội phạm.

3. Hoạt động phạm tội mang tính chất hệ thống, có sự chỉ huy thống nhất, mục đích cuối cùng là thu lợi bất hợp pháp về kinh tế.

4. Những tên cầm đầu luôn tìm mọi cách tạo vỏ bọc kín để chỉ huy các thành viên hoạt động phạm tội. Các vỏ bọc này thường dưới các hình thức phụ trách nhà hàng, khách sạn, tổ đội lao động, các công ty tư nhân, nhà doanh nghiệp... Thậm chí cả hoạt động từ thiện để từng bước ra công khai, tạo uy tín và đi vào con đường làm giàu.

5. Móc nối với một số cán bộ, nhân viên nhà nước biến chất, bằng nhiều thủ đoạn với mục đích lôi kéo họ giúp đỡ, tạo điều kiện che chắn cho bọn chúng trong việc thực hiện và che giấu tội phạm hoặc để trốn tránh pháp luật khi cần thiết.
