1. Cá nhân cư trú là người đáp ứng

1. Cá nhân cư trú là người đáp ứng một trong các điều kiện sau đây:
a) Có mặt tại Việt Nam từ 183 ngày trở lên tính trong một năm dương lịch hoặc trong 12 tháng liên tục kể từ ngày đầu tiên có mặt tại Việt Nam, trong đó ngày đến và ngày đi được tính là một (01) ngày. Ngày đến và ngày đi được căn cứ vào chứng thực của cơ quan quản lý xuất nhập cảnh trên hộ chiếu (hoặc giấy thông hành) của cá nhân khi đến và khi rời Việt Nam. Trường hợp nhập cảnh và xuất cảnh trong cùng một ngày thì được tính chung là một ngày cư trú.
Cá nhân có mặt tại Việt Nam theo hướng dẫn tại điểm này là sự hiện diện của cá nhân đó trên lãnh thổ Việt Nam.
b) Có nơi ở thường xuyên tại Việt Nam theo một trong hai trường hợp sau:
b.1) Có nơi ở thường xuyên theo quy định của pháp luật về cư trú:
b.1.1) Đối với công dân Việt Nam: nơi ở thường xuyên là nơi cá nhân sinh sống thường xuyên, ổn định không có thời hạn tại một chỗ ở nhất định và đã đăng ký thường trú theo quy định của pháp luật về cư trú.

Arrival date and departure date are based on the endorsement of the Immigration Administration on Passport (or passport) of individuals when to and when to leave Vietnam. The case of entry and exit in the same day shall be counted as one day.Individuals present in Vietnam according to instructions at this point is that individual's presence on the territory of Vietnam.b) Have regular residence in Vietnam in one of two situations:b. 1) Have regular residence under the provisions of the law on residence:b. 1.1) for Vietnam citizens: where in was often the individuals live regular, stable with no time limit at a certain accommodation and have registered permanent residence in accordance with the law on residency.

1. Resident individuals who meet one of the following conditions:
a) Have been in Vietnam for 183 days or more in a calendar year or for 12 consecutive months from the date of entry in Vietnam, including the arrival and departure day is counted as one (01) days. Date of arrival and departure shall be based on the agency's authentication management Immigration passport (or passport) of individuals entering and leaving Vietnam. In case of entry and exit on the same day they are generally a day of residence.
Individuals have been in Vietnam following the instructions at this point is the presence of such individuals in the Vietnam territory.
B) have permanent residence in Vietnam as one of the two following situations:
b.1) have permanent residence in accordance with the law on residence:
b.1.1) for citizens of Vietnam: permanent accommodation where individuals live regularly, stable indefinitely, at a certain place at a registered permanent residence and in accordance with the law on residence.
