Điều 37. Các biện pháp xử lý rủi ro
1. Bộ Tài chính thực hiện phân loại nợ trong quá trình theo dõi khoản vay, khoản phát hành trái phiếu.
2. Bộ Tài chính thông báo cho Ngân hàng Nhà nước Việt Nam về những người được bảo lãnh có nợ được Chính phủ bảo lãnh hoặc nợ với Quỹ Tích lũy trả nợ thuộc nhóm 4 và nhóm 5 để tổng hợp vào hệ thống thông tin tín dụng của ngân hàng.
3. Người được bảo lãnh có các khoản nợ được Chính phủ bảo lãnh hoặc nợ Quỹ Tích lũy thuộc nhóm 4 và nhóm 5 trong bảng phân loại nợ sẽ phải áp dụng các biện pháp sau:
a) Nếu có nợ thuộc nhóm 4: Người được bảo lãnh có trách nhiệm báo cáo định kỳ hàng tháng cho Bộ Tài chính và cơ quan chủ quản (nếu có) về toàn bộ dòng tiền thu, chi của doanh nghiệp.
b) Nếu có nợ thuộc nhóm 5: Người được bảo lãnh có trách nhiệm chấp hành các biện pháp xử lý theo phê duyệt của Thủ tướng Chính phủ, kể cả việc xử lý tài sản bảo đảm (nếu có) để thu hồi nợ.
4. Hàng năm, Quỹ Tích lũy trả nợ bố trí nguồn dự phòng trả nợ đối với các khoản vay được Chính phủ bảo lãnh thuộc nhóm 4 và 5 theo nguyên tắc đảm bảo số dư Quỹ Tích lũy trả nợ ít nhất bằng nghĩa vụ phải trả trong năm của các khoản này. Trường hợp Quỹ Tích lũy trả nợ không đủ nguồn, Bộ Tài chính báo cáo Thủ tướng Chính phủ phương án xử lý.

The case is not enough to repay the accumulated Fund sources, the Finance Ministry reported the Prime process.

Article 37. The risk treatment measures
1. The Ministry of Finance shall classify creditors in the process of monitoring loans, bond issuance amounts.
2. Ministry of Finance informs the State Bank of Vietnam on the debt guaranteed by the Government guarantees or debt repayment Accumulation Fund under group 4 and 5 for general information on the credit system of bank.
3. The guaranteed loans have been guaranteed by the Government or the Fund Debt Accumulation of group 4 and 5 in the classification of debt will have to apply the following measures:
a) If the debt of heading 4: Reserved responsible leaders monthly report to the Ministry of Finance and the agency (if any) on the entire line of revenues and expenses of the business.

4. Annually, the Foundation arranged Accumulating debt reserve source of repayment for the loan is guaranteed by the Government of heading 4 and 5 on the principle of ensuring balance Accumulation Fund to repay at least equal obligation to pay in five of these items. Where Accumulation Fund are not sufficient to pay the debt, the Finance Ministry reported to the Prime Minister plans for dealing.
