Hiện bên B đang tiến hành thủ tục xin nhập quốc tịch Việt Nam, đã nộp hồ sơ lên Đại sứ quán Việt Nam tại Hoa Kỳ và đang chờ sự đồng ý để được phép mua quyền sử dụng đất và nhà ở gắn liền với đất tại Việt Nam.

Qua bàn bạc trao đổi, hai bên cùng thống nhất lập hợp đồng hứa mua - hứa bán nhà và chuyển nhượng quyền sử dụng đất với những nội dung sau:
ĐIỀU 1
QUYỀN SỬ DỤNG ĐẤT VÀ TÀI SẢN GẮN LIỀN VỚI ĐẤT ĐỂ HỨA MUA HỨA BÁN

Bên A là đồng sở hữu, sử dụng ngôi nhà gắn liền với quyền sử dụng đất tại địa chỉ: Khối 6 (nay là Xuân Thuận), phường Cẩm Phô, thành phố Hội An, tỉnh Quảng Nam theo Giấy chứng nhận quyền sử dụng đất số AH 993771 (số phát hành giấy CNQSDĐ : H00890) do Ủy ban nhân dân thị xã (nay là thành phố) Hội An cấp ngày 09/02/2007 và theo Giấy phép xây dựng nhà ở số 36/GPXD do Ủy ban nhân dân Tp. Hội An cấp ngày 14/3/2008, cụ thể:
• Thửa đất:
- Thửa số: 349 - Tờ bản đồ số: 25
- Diện tích: 38,4m2 (ba mươi tám phẩy tư mét vuông)
Diện tích thửa đất nêu trên đã được trừ sau khi bên A làm thủ tục tách thửa diện tích 6m2 (Sáu mét vuông) để trả lại và hợp lại với thửa đất liền kề.
- Hình thức sử dụng: Sử dụng riêng
- Mục đích sử dụng: Đất ở tại đô thị
- Thời hạn sử dụng: Lâu dài
- Nguồn gốc sử dụng đất: Nhà nước công nhận quyền sử dụng đất
• Ngôi nhà:
- Loại nhà ở: Nhà ở riêng lẻ
- Tổng diện tích: 91,62m2 (Chín mươi mốt phẩy sáu mươi hai mét vuông)
- Kết cấu: Nhà 3 tầng, khung sàn BTCT chịu lực, tường xây, mái lợp ngói, nền lát gạch men.
Bên A hứa bán cho bên B và bên B hứa mua căn nhà và nhận chuyển nhượng thửa đất số 349, tờ bản đồ số 25 tại Khối 6 (nay là Xuân Thuận), phường Cẩm Phô, thành phố Hội An, tỉnh Quảng Nam theo Giấy chứng nhận quyền sử dụng đất và Giấy phép xây dựng nhà ở nêu trên.

ĐIỀU 2
GIÁ HỨA MUA HỨA BÁN VÀ PHƯƠNG THỨC THANH TOÁN

1. Giá mua bán:
Hai bên thỏa thuận giá mua bán là: 900.000.000 đồng (Chín trăm triệu đồng Việt Nam).
Thuế, lệ phí và các khoản phí khác do hai bên tự thỏa thuận chịu trách nhiệm nộp.
2. Phương thức thanh toán: Chuyển khoản, bên B có nghĩa vụ giao trước cho bên A số tiền 100.000.000 đồng (Bằng chữ: Một trăm triệu đồng Việt Nam).
Số tiền còn lại là 800.000.000 đồng (Tám trăm triệu đồng Việt Nam), bên B sẽ thanh toán cho bên A sau khi Hợp đồng chuyển nhượng quyền sử dụng đất và tài sản gắn liền với đất được ký kết và công chứng.
3. Việc thanh toán số tiền nêu tại khoản 1 Điều này do hai bên tự thực hiện và chịu trách nhiệm trước pháp luật.
ĐIỀU 3
THỜI ĐIỂM MUA BÁN NHÀ
VÀ CHUYỂN NHƯỢNG QUYỀN SỬ DỤNG ĐẤT
Sau 03 (ba) tháng kể từ ngày Hợp đồng này được công chứng, bên B có nghĩa vụ hoàn tất thủ tục nhập quốc tịch Việt Nam và cho đến khi bên B đủ điều kiện mua nhà và nhận chuyển nhượng quyền sử dụng đất, hai bên có nghĩa vụ giao kết hợp đồng chuyển nhượng quyền sử dụng đất và căn nhà gắn liền với đất nêu tại Điều 1 Hợp đồng này.
ĐIỀU 4
PHƯƠNG THỨC GIẢI QUYẾT TRANH CHẤP HỢP ĐỒNG
Trong quá trình thực hiện Hợp đồng mà phát sinh tranh chấp, các bên cùng nhau thương lượng giải quyết trên nguyên tắc tôn trọng quyền lợi của nhau; trong trường hợp không giải quyết được, thì một trong hai bên có quyền khởi kiện để yêu cầu toà án có thẩm quyền giải quyết theo quy định của pháp luật.
ĐIỀU 5
CAM KẾT CỦA CÁC BÊN

1. Hai bên cam kết thực hiện đúng các điều khoản trên, không bên nào tự ý thay đổi nội dung hợp đồng.
2. Hai bên cam kết giá bán trên là giá cố định không thay đổi trong trường hợp giá cả thị trường lên hay xuống.
3. Trường hợp sau 03 (ba) tháng kể từ ngày Hợp đồng này được công chứng, bên B không thể xin nhập quốc tịch Việt Nam thì bên A có nghĩa vụ hoàn trả cho bên B số tiền giao trước là 100.000.000 đồng, đồng thời bên B có nghĩa vụ thối trả lại cho bên A số tiền 15.000.000 đồng (Mười lăm triệu đồng Việt Nam).
