13. Về đề xuất liên quan đến chiều cao công trình, dự án trong VPEZ
Theo quy định tại khoản 5 Điều 4 và Điều 14 Nghị định 20/2009/NĐ-CP ngày 23/2/2009 của Chính phủ về quản lý độ cao chướng ngại vật hàng không và các trận địa quản lý bảo vệ vùng trời Việt Nam, trong quá trình triển khai thực hiện dự án đầu tư, khi thực hiện thủ tục lập, thẩm định, phê duyệt quy hoạch chung hoặc quy hoạch chi tiết khu đô thị, khu nhà ở cao tầng hoặc trường hợp thực hiện các công trình, dự án riêng biệt có chiều cao hơn 45m so với mặt đất tự nhiên nằm ngoài khu vực đã được phê duyệt quy hoạch về độ cao tĩnh không, nhà đầu tư phải xin ý kiến chấp thuận của Bộ Tổng tham mưu Quân đội nhân dân Việt Nam hoặc Bộ Quốc Phòng. Vấn đề này không thuộc thẩm quyền quyết định của UBND tỉnh Khánh Hòa. Tuy nhiên, tỉnh Khánh Hòa cũng sẽ hỗ trợ nhà đầu tư khi thực hiện các thủ tục này.
