Trường hợp đến hạn bàn giao căn hộ

Trường hợp đến hạn bàn giao căn hộ theo thông báo của bên bán và căn hộ đã đủ điều kiện bàn giao theo thỏa thuận trong hợp đồng này mà bên mua không nhận bàn giao thì:

Bên bán xem như đã hoàn thành việc bàn giao căn hộ và bên mua được xem như mặc nhiên nhận bàn giao căn hộ theo quy định tại điều 8 của hợp đồng này nếu bên mua đã hoàn thành tất cả các nghĩa vụ thanh toán đến hạn bao gồm cả đợt thanh toán quy định tại điều 8.1.3 của hợp đồng này

Bên bán có quyền lựa chọn việc gia hạn thời gian nhận bàn giao căn hộ và thanh toán số tiền quy định tại điều 8.1.3 của hợp đồng này ( khi đó bên bán có quyền áp dụng tính lãi suất phạt quá hạn quy định tại điều 12.1.1 của hợp đồng nàY) hoặc bên bán có quyền đơn phương chấm dứt hộ đồng theo thỏa thuận tại điều 15 của hợp đồng này

Trong trường hợp bên bán đơn phương chấm dứt hợp đồng thì bên bán được quyền bán căn hộ cho khách hàng khác mà không cần có sự đồng ý của bên mua. Bên bán sẽ hoàn trả lại số tiền mà bên mua đã thanh toán ( không tính lãi suất) sau khi đã khấu trừ tiền bồi thường về việc bên mua vi phạm hợp đồng này là 15% tổng giá trị hợp đồng này ( chưa tính thuế), tiền bồi thường các tổn thất hoặc thiệt hại thực tế phát sinh từ việc vi phạm hợp đồng của bên mua ( nếu có), khoản tiền lãi do chậm thanh toán theo quy định tại điều 12.1.1 của hợp đồng này ( nếu có)
