Hợp đồng xây dựng này (sau đây gọi tắt là Hợp đồng) được làm và bắt đầu thực hiện từ ngày 09 tháng 12 năm 2014.
Tổ chức Good People International (GPI) - một tổ chức phi chính phủ có địa chỉ tại tầng 4, Tòa nhà Good People, Số 10 Gukhoe-daero 74 - gil, Youngdeungpo-Gu, Thủ đô Seoul, Hàn Quốc - hoạt động tại Việt nam với địa chỉ tại Villa D30 - The Manor Mỹ Đình, Mễ Trì, Từ Liêm, Hà Nội - được đại diện bởi Ông Young - Hun Lee, Giám đốc điều hành - sau đây gọi là Bên giao thầu.
Và:
Công ty trách nhiệm hữu hạn Hồng Phong, có địa chỉ tại thôn Phượng Hùng 1, xã Chí Đám, huyện Đoan Hùng, tỉnh Phú Thọ - được đại diện bởi ông Nguyễn Doãn Pha, chức vụ Giám đốc - sau đây gọi là bên nhận thầu
Chứng kiến:
Xem xét việc "Bên giao thầu" và "Bên nhận thầu" thỏa thuận thực hiện Dự án tại xã Chân Mộng, huyện Đoan Hùng tỉnh Phú Thọ, Việt Nam như sau:
1. Xây dựng một nhà trường trung học cơ sở tại xã Chân Mộng, huyện Đoan Hùng, tỉnh Phú Thọ, Việt Nam.
2. Cấu trúc công trình: Gồm một nhà hai tầng sáu phòng học.
"Bên nhận thầu' đã trình đề án thiết kế và xây dựng của dự án và "Bên giao thầu" đã chấp nhận và giao dự án cho bên nhận thầu.
"Bên giao thầu" và "Bên nhận thầu" thống nhất theo dõi thực hiện những điều khoản và điều kiện được nhắc đến như sau:
Điều 1: Các khái niệm
Trong hợp đồng, theo như định nghĩa dưới đây, các từ và cụm từ sau sẽ có ý nghĩa như định nghĩa dưới đây, nếu trong câu văn không yêu cầu phải theo nghĩa khác:
a. "Bên giao thầu" nghĩa là Tổ chức Good People International GPI và bao gồm đại diện các nhân của Bên giao thầu được trụ sở chính GPI tiến cử.
b. "Bên nhận thầu" là Công ty trách nhiệm hữu hạn Hồng Phong đơn vị được chấp nhận bởi "Bên giao thầu" và bao gồm đại diện cá nhân được "Bên nhận thầu" tiến cử.
c. "Bên" là Bên giao thầu và Bên nhận thầu, và có thể là trong một số trường hợp "Các bên" sẽ có nghĩa là cả hai bên.
d. Dự án là xây dựng trường trung học cơ sở tại xã Chân Mộng, huyện Đoan Hùng, tỉnh Phú Thọ, Việt Nam, trong đó có một nhà hai tầng với sáu phòng học.
e. Công trình là phạm vi công trình thực hiện Dự án theo hợp đồng và bao gồm cả công việc thường xuyên và công việc tạm thời.
f. Hợp đồng là những điều kiện thuộc hợp đồng này, thuyết minh kỹ thuật và các bản vẽ.
g. Giá trị hợp đồng là tổng giá trị của tất cả các công việc mà Bên giao thầu phải trả cho Bên nhận thầu
h. Thuyết minh kỹ thuật là các điều kiện theo kế hoạch và bản vẽ liên quan đến hợp đồng và được bên giao thầu duyệt bằng văn bản.
i. Bản vẽ là các kế hoạch được nêu trong phần thuyết minh kỹ thuật và bất kỳ thay đổi nào trong bản vẽ hoặc kế hoạch đều phải được bên giao thầu duyệt bằng văn bản
