HỢP ĐỒNG VAY TIỀN

Hôm nay, ngày tháng 8 năm 2016 tại trụ sở Công ty cổ phần Thời trang Nguồn Lực (Lô số 7, KCN Điện Nam - Điện Ngọc, phường Điện Ngọc, thị xã Điện Bàn, tỉnh Quảng Nam, Việt Nam).
Chúng tôi cùng ký tên dưới đây, những cá nhân có đầy đủ năng lực hành vi dân sự, đang trong trạng thái tinh thần hoàn toàn minh mẫn, sáng suốt, không bị lừa dối, ép buộc và cam kết tự chịu trách nhiệm trước pháp luật về mọi hành vi của mình, gồm:
I. Bên cho vay.

II. Bên vay.
Ông: KUMAR PREM Sinh ngày: 20/02/1979 Quốc tịch: Ấn Độ
Hộ chiếu số: Z 2538480 cấp ngày 10/9/2013 tại Ấn Độ.
Địa chỉ: C1507 đường 37 Nguyễn Văn Hưởng, phường Thảo Điền, quận 2, Tp HCM.
Sau khi thỏa thuận, các bên đồng ý ký Hợp đồng vay tiền với các điều khoản như sau:
1. Ông Lâm Quang Thái đồng ý cho Ông Kumar Prem vay số tiền là: 1.817.750.000đồng (Một tỷ, tám trăm mười bảy triệu, bảy trăm năm mươi nghìn đồng).
2. Mục đích vay tiền: Để trả tiền mua cổ phần tại Công ty cổ phần Thời trang Nguồn Lực.
3. Lãi suất: 5%/ năm (Năm phần trăm một năm).
4. Thời hạn vay: 24 tháng kể từ ngày ký Hợp đồng này.
5. Thời hạn trả nợ: Ông Kumar Prem có nghĩa vụ thanh toán đầy đủ số tiền 1.817.750.000đồng (Một tỷ, tám trăm mười bảy triệu, bảy trăm năm mươi nghìn đồng). và toàn bộ tiền lãi cho ông Lâm Quang Thái vào ngày cuối thời hạn vay nêu ở điểm 4 của Hợp đồng này.
6. Phương thức cho vay: Bằng tiền mặt hoặc chuyển khoản.
7. Bằng văn bản này, Ông Kumar Prem xác nhận đã nhận đủ số tiền 1.817.750.000đồng (Một tỷ, tám trăm mười bảy triệu, bảy trăm năm mươi nghìn đồng).của ông Lâm Quang Thái và cam kết thực hiện thanh toán số tiền trên và tiền lãi đầy đủ và đúng hạn.
Hợp đồng này có hiệu lực kể từ ngày ký, được lập thành 02 (hai) bản chính bằng tiếng Việt và tiếng Anh, trong đó bản tiếng Việt có giá trị pháp lý bắt buộc, mỗi bên giữ 01 (một) bản để thực hiện. Mọi bản sao chụp chỉ có giá trị đối chiếu. Các khế ước nhận nợ, chứng từ giao nhận, chuyển tiền, thanh toán không tách rời Hợp đồng này.
