Theo quy định trên, trường hợp Công ty Stolle cung cấp dịch vụ giám sát, kiểm tra kỹ thuật và chạy thử thông qua các chuyên gia nước ngoài sang Việt Nam trong một giai đoạn không quá 6 tháng theo Hợp đồng ký ngày 24/10/2014 với Công ty Hanacans về việc cung cấp dây chuyền sản xuất nắp lon và thực hiện dịch vụ giám sát, kiểm tra kỹ thuật, lắp đặt và chạy thử dây chuyền, Công ty Stolle được coi là không có cơ sở kinh doanh cố định tại Việt Nam đối với hoạt động cung cấp dịch vụ nêu trên nên không có cơ sở thường trú tại Việt Nam.
