Phạm vi nội dung của RCEP:
Một trong những trọng tâm chính của RCEP là làm hài hòa các quy định hiện hành và những ứng dụng của chúng trong khuôn khổ các hiệp định FTA của ASEAN. Vì các nước thành viên của RCEP không chỉ tham gia vào hiệp định này mà còn có các hiệp định FTA khác. Do đó, các chính sách của RCEP cần tránh sự xung đột với chính sách của các hiệp dịnh khác ,nhất là cascc hiệp định FTA của ASEAN.
Hiệp định đề xuất phải phù hợp với Hiệp định WTO.
Quy định đối xử đặc biệt và khác biệt đối với những nước thành viên ASEAN kém phát triển, nhất là Campuchia, Lào, Myanmar và Việt Nam. Với một số chính sách ưu đãi sẽ làm tăng tính linh hoạt cũng như khả năng cạnh tranh của những nước này với các nước thành viên có nền kinh tế phát triển như Trung Quốc, Nhật Bản…
Giống như các hiệp định FTA thế hệ mới, 2 nội dung chính của RCEP:
- Nội dung liên quan đến tiếp cận thị trường;
- Những nội dung mới khác liên quan đến tự do hóa thương mại và đầu tư.
Phạm vi đàm phán bao gồm 8 lĩnh vực:
- Thương mại hàng hoá;
Nới lỏng hàng rào thuế quan, kích thích phát triển thương mại
- Thương mại dịch vụ;
Chuyển giao công nghệ dịch vụ chất lượng cao, tạo đà cho sự phát triển thương mại dịch vụ
- Đầu tư;
- Hợp tác kinh tế và kỹ thuật:
• Nhằm thu hẹp khoảng cách phát triển giữa các bên tham gia. Giúp các nước đang phát triển có thể đuổi kịp tiến bộ khoa học của các nước khác.
• Xây dựng trên cơ sở các thỏa thuận hợp tác kinh tế hiện có giữa ASEAN và các đối tác FTA của ASEAN tham gia RCEP.
• Hợp tác về mặt thương mại điện tử và các lĩnh vực khác được các nước tham gia RCEP đồng thuận.
- Sở hữu trí tuệ:
• Giảm các rào cản thương mại và đầu tư liên quan đến sở hữu trí tuệ thông qua thúc đẩy hội nhập và hợp tác kinh tế trong vận dụng, bảo vệ và thực thi quyền sở hữu trí tuệ.
• Các vấn đề trong lĩnh vực này:
+ Những vấn đề về internet như đường truyền internet, trách nhiệm của các ISP, hình sự hóa các hành vi vi phạm;
+ Vấn đề liên quan đến y tế cộng đồng như “tiếp cận thuốc men”, vấn đề liên quan đến những chương trình định giá và bồi hoàn dược phẩm;
+ Các vấn đề về bằng sáng chế, bản quyền và thương hiệu.
- Cạnh tranh:
• Tạo nền tảng cho các bên tham gia hợp tác trong việc tăng cường cạnh tranh, hiệu quả kinh tế, lợi ích của người tiêu dùng và tránh các hành vi hạn chế cạnh tranh đồng thời ý thức rõ về sự khác biệt lớn trong năng lực và quy chế quốc gia của các nước tham gia RCEP trong lĩnh vực này.
- Giải quyết tranh chấp:
• RCEP quy định một cơ chế giải quyết tranh chấp có một quy trình có hiệu quả, hiệu suất và minh bạch nhằm tham vấn và giải quyết tranh chấp.
 Đảm bảo tuân thủ việc thực thi cam kết sâu rộng hơn của các thành viên nhằm hình thành động lực thay đổi, gây ra bởi áp lực trong nước.
• Quy trình giải quyết tranh chấp minh bạch hơn có thể truyền tải nhiều thông điệp hơn tới cộng đồng doanh nghiệp về cách thức tận dụng các quy tắc RCEP và hành động một cách chiến lược và hiệu quả trong quá trình thuê ngoài và xây dựng dây chuyền sản xuất.
