Theo quy định của pháp luật, Công dân nước Cộng hòa xã hội chủ nghĩa Việt Nam không phân biệt dân tộc, nam nữ, thành phần xã hội, tín ngưỡng, tôn giáo, trình độ văn hoá, nghề nghiệp, thời hạn cư trú, đủ mười tám tuổi trở lên đều có quyền bầu cử. Tuy nhiên, để được bầu làm đại biểu Quốc hội, người ứng cử phải bảo đảm những tiêu chuẩn đại biểu Quốc hội theo quy định của pháp luật. Hội đồng nhân dân, người ứng cử còn phải bảo đảm những tiêu chuẩn đại biểu Hội đồng nhân dân theo quy định của pháp luật.

Công dân có đủ điều kiện, tiêu chuẩn theo quy định của Luật Bầu cử đại biểu Quốc hội và Luật Bầu cử đại biểu Hội đồng nhân dân chỉ được ứng cử đại biểu Hội đồng nhân dân không quá hai cấp; nếu đã ứng cử đại biểu Quốc hội thì chỉ được ứng cử đại biểu Hội đồng nhân dân một cấp.
