Xét tính hợp pháp: UBND phường xác nhận từ ngày 10.01.2008 đến ngày 16.01.2008. Theo bản án số 04 ngày 16.01.2008, từ ngày 16.01.2008 thì quan hệ hôn nhân mới chấm dứt. Như vậy việc UBND phường xác nhận là sai.
Thứ hai: quan hệ hôn nhân chấm dứt ngày 16.01.2008 thời điểm này đương sự đã ở nước ngòai (theo thông tin của hàng xóm xác nhận đương sự rời khỏi Việt Nam). Như vậy UBND phường Quang Trung không có thẩm quyền cấp giấy xác nhận tình trạng hôn nhân, mà thẩm quyền thuộc về cơ quan ngoại giao của Việt Nam tại Đức
Mss. Hà – cán bộ tư pháp hộ tịch nói do chị mới tiếp nhận nhiệm vụ nên không biết nội dung vụ việc này. Cán bộ tư pháp hộ tịch thời điểm cấp giấy xác nhận đã chuyển công tác.
