Biện pháp này không được tạo ra phân biệt đối xử tùy tiện và vô lý
Dựa trên cơ sở Điều 2. 3, Điều 5. 5 và án lệ Australia – Salmon thì để chúng minh biện pháp của Richland có tạo ra sự phân biệt đối xử tùy tiện và vô lý hay không, cần trả lời hai nội dung sau:
+ Có tồn tại sự phân biệt đối xử: Chỉ có trái cây giới thiệu, bán ở Richland mới chịu sự áp dụng của quy định này , trong khi trái cây xuất khẩu của Richland thì không.
