QUYẾT ĐỊNH
CÔNG NHẬN THUẬN TÌNH LY HÔN VÀ SỰ THOẢ THUẬN
CỦA CÁC ĐƯƠNG SỰ

Căn cứ vào Điều 187 và Điều 188 của Bộ luật tố tụng dân sự;
Căn cứ vào Điều 90 Luật hôn nhân và gia đình;
Căn cứ vào biên bản ghi nhận sự tự nguyện ly hôn và hoà giải thành ngày 26 tháng 10 năm 2008 về việc các đương sự đã thật sự tự nguyện ly hôn và thoả thuận được với nhau về việc giải quyết toàn bộ vụ án về hôn nhân và gia đình thụ lý số:38/2008/TLST-HNGĐ ngày 26 tháng 10 năm 2008.
XÉT THẤY:

Việc thuận tình ly hôn và thoả thuận của các đương sự được ghi trong biên bản ghi nhận sự tự nguyện ly hôn và hoà giải thành ngày 26 tháng 10 năm 2008 là hoàn toàn tự nguyện và không trái pháp luật, không trái đạo đức xã hội.

Đã hết thời hạn bảy ngày, kể từ ngày lập biên bản ghi nhận sự tự nguyện ly hôn và hoà giải thành, không có đương sự nào thay đổi ý kiến về sự thoả thuận đó.

QUYẾT ĐỊNH:

1. Công nhận sự thuận tình ly hôn giữa :
Anh : Trần Đức Đoan. Sinh ngày : 30/11/1972.
Nơi thường trú : Xã Tông Phan, huyện Phù Cừ, tỉnh Hưng Yên.
Cùng chị : Hoàng Thị Thạo. Sinh ngày : 18/06/1977.
Nơi thường trú : Xóm 5 thôn Cát Dương, xã Tông Phan, huyện Phù Cừ, tỉnh Hưng Yên.
2. Công nhận sự thoả thuận của các đương sự:
- Nguyên đơn : Hoàng Thị Thạo.
- Bị đơn : Trần Đức Đoan.
Đều trú tại : Xóm 5 thôn Cát Dương, xã Tông Phan, huyện Phù Cừ, tỉnh Hưng Yên.
3. Sự thoả thuận của các đương sự cụ thể như sau:
 Về con chung :
Giao một con chung Trần Danh Tuấn , sinh ngày 20/08/1996 cho anh Trần Đức Đoan trực tiếp chăm sóc và nuôi dưỡng đến tuổi trưởng thành.
Chị Thạo có nghĩa vụ trợ cấp phí tổn nuôi con chung là cháu Trần Danh Tuấn mỗi tháng 200.000đ cho anh Đoan kể từ ngày quyết định có hiệu lực pháp luật cho đến khi con chung trưởng thành.
Các bên có quyền đi lại thăm nom con chung, không ai được cản trở. Vì lợi ích của con, theo yêu cầu của một hoặc cả 2 bên, tòa án có thể quyết định thay đổi người trực tiếp nuôi con hoặc mức đóng góp phí tổn nuôi con chung.
 Về tài sản chung :
Giao cho anh Trần Đức Đoan toàn quyền sở hữu và sử dụng 01 căn nhà 2 tầng tọa lạc trên lô đất thổ cư có diện tích 205m² tại xóm 5 thôn Cát Dương, xã Tông Phan, huyện Phù Cừ, tỉnh Hưng Yên. Có giá trị 450.000.000đ.
Đối với các tài sản khác các bên không yêu cầu giải quyết nên Tòa không đặt ra để giải quyết.
 Về án phí : Các bên thỏa thuận chị Hoàng Thị Thạo phải chịu 100.000đ án phí LHST , được khấu trừ vào số tiền 100.000đ tạm ứng án phí đã nộp theo biên lai số 003568 ngày 26 tháng 10 năm 2008 của thi hành án dân sự huyện Phù Cừ.
4. . Quyết định này có hiệu lực pháp luật ngay sau khi được ban hành và không bị kháng cáo, kháng nghị theo thủ tục phúc thẩm.
