Bước 3: Kiểm tra thực tế hàng hóa
1. Trách nhiệm của Chi cục trưởng
a) Chi cục trưởng Chi cục hải quan xem xét đề xuất của công chức kiểm tra hồ sơ để quyết định việc kiểm tra thực tế hàng hóa và phân công công chức kiểm tra thực tế hàng hóa thông qua Màn hình NA02A.
Trường hợp phân công cho nhiều hơn 01 công chức thực hiện kiểm tra thực tế hàng hóa, thực hiện phân công 01 công chức tại ô “Tên người phụ trách kiểm hóa”, các công chức còn lại ghi nhận tại ô “Cập nhật ý kiến của Lãnh đạo” trên Màn hình kiểm tra thông tin tờ khai - Kiểm tra thực tế hàng hóa.
Đối với những tờ khai liên kết với số tờ khai khác (lô hàng có trên 50 dòng hàng) trong đó có hơn 01 tờ khai phân luồng đỏ thì toàn bộ các tờ khai luồng đỏ phân công cho nhóm công chức kiểm tra thực tế hàng hóa các tờ khai thuộc lô hàng.
Đối với tờ khai chuyển luồng từ luồng vàng sang luồng đỏ, sau khi phê duyệt đề xuất chuyển luồng của công chức kiểm tra hồ sơ, Chi cục trưởng trực tiếp tiến hành phân công công chức kiểm tra thực tế hàng hóa (trừ trường hợp kiểm tra thực tế hàng hóa bằng máy soi container dùng chung).
b) Quyết định hình thức, mức độ kiểm tra, chỉ đạo các nội dung công chức cần kiểm tra; phê duyệt đề xuất của công chức kiểm tra thực tế hàng hóa, quyết định việc tạm dừng hoàn thành việc kiểm tra và hủy tạm dừng hoàn thành kiểm tra thông qua chức năng Tạm dừng và Hủy tạm dừng CEA/CEE (nếu có) tại Màn hình kiểm tra thông tin tờ khai - Kiểm tra thực tế hàng hóa; việc chỉ đạo và phê duyệt phải được cập nhật vào Hệ thống tại ô “Cập nhật ý kiến của Lãnh đạo”.
Đối với các Cục Hải quan được trang bị máy soi container, việc kiểm tra thực tế hàng hóa được thực hiện qua máy soi container trừ trường hợp máy soi container gặp sự cố, hàng hóa không phù hợp với việc soi chiếu, hàng hóa bắt buộc phải kiểm tra trực tiếp bởi công chức hải quan theo hướng dẫn của Tổng cục Hải quan, lượng hàng hóa phải kiểm tra thực tế vượt quá công suất của máy soi container hoặc năng lực xếp dỡ của doanh nghiệp kinh doanh cảng, kho, bãi nơi lắp đặt máy soi.
c) Rà soát yêu cầu kiểm tra thực tế hàng hóa từ những Chi cục Hải quan khác trên Hệ thống e-Customs (thông qua chức năng .........) để phân công công chức kiểm tra thực tế hàng hóa và thông báo hình thức, mức độ kiểm tra theo đúng yêu cầu của Chi cục Hải quan nhờ kiểm tra thực tế trên Phiếu ghi kết quả kiểm tra theo mẫu số 06/PGKQKT/GSQL Phụ lục V Thông tư 38/2015/TT-BTC.
