Sau khi bàn bạc và thảo luận, hai bên đồng ý ký kết Hợp đồng với các điều khoản sau:
ĐIỀU 1: NỘI DUNG HỢP ĐỒNG
- Bên A là đơn vị thực hiện sự kiện: Triển lãm Motorshow năm 2015
- Bên B làm người mẫu cho sự kiện của bên A
- Địa điểm làm việc: Trung tâm Hội Chợ và Triển Lãm Sài Gòn – SECC, quận 7, Tp.HCM
- Thời hạn hợp đồng: 9:00 – 17:00 từ ngày 28/10/2015 đến ngày 01/11/2015
- Thời gian làm việc: tối đa 2 ca/ngày, thời gian mỗi ca từ 2 đến 2,5 tiếng.

ĐIỀU 2: GIÁ TRỊ HỢP ĐỒNG VÀ PHƯƠNG THỨC THANH TOÁN
2.1. Giá trị hợp đồng là: …………………………………………………………………

2.2. Phương thức thanh toán như sau:
Thanh toán bằng tiền mặt hoặc chuyển khoản và thanh toán làm 2 đợt:
- Đợt 1: Bên A tạm ứng (tiền cọc) cho Bên B 50% giá trị hợp đồng tương đương với số tiền là: ………………………………… (bằng chữ: …………………………………………………………………… ) vào ngày 01/11/2015.
- Đợt 2: Bên A thanh toán cho Bên B 50% số tiền còn lại sau 7 ngày kết thúc chương trình tức ngày 08/11/2015.
2.3. Thuế TNCN phát sinh liên quan đến Hợp đồng này, Bên A sẽ nộp cho cơ quan thuế theo quy định của pháp luật hiện hành cho bên B nếu Bên B thuộc đối tượng nộp Thuế TNCN theo quy định của pháp luật.

ĐIỀU 3: NGHĨA VỤ VÀ QUYỀN LỢI CỦA BÊN A
3.1. Bên A có nghĩa vụ sau đây:
- Bố trí đúng công việc, địa điểm làm việc, đồng phục (nếu có) cho bên B
- Thanh toán thù lao đầy đủ và đúng thời hạn cho bên B như đã thỏa thuận tại Hợp đồng. Nếu trễ bên A sẽ chịu lãi suất 2%/ngày trên tổng giá trị hợp đồng
- Thông báo cho bên B kịp thời khi có sự thay đổi về thời gian của chương trình
- Không được tự ý hủy bỏ hợp đồng, nếu vi phạm điều này thì bên A phải trả cho bên B một khoản tiền tương đương 100% tổng giá trị hợp đồng.
3.2. Bên A có quyền sau đây:
- Bên A có quyền kiểm tra, giám sát bên B nhằm đảm bảo bên B thực hiện đúng các cam kết theo hợp đồng.
- Mọi kết quả thực hiện được thông qua hợp đồng này, kể cả hình ảnh của bên B thuộc quyền sở hữu của bên A. Bên A có toàn quyền sử dụng kết quả đó cho toàn bộ hoạt động của mình.
- Có quyền yêu cầu bên B thực hiện các báo cáo chi tiết trong quá trình thực hiện Hợp đồng

ĐIỀU 4: NGHĨA VỤ VÀ QUYỀN LỢI CỦA BÊN B
4.1. Bên B có nghĩa vụ sau đây:
- Có mặt đúng giờ theo thời gian quy định tại điều 1 và đảm bảo hoàn thành tốt công việc
- Tuyệt đối bảo mật thông tin về mức lương khi tham gia chương trình.
- Trang phục đúng theo yêu cầu.
- Nếu gặp khó khăn, vướng mắc, bất tiện trong quá trình làm việc thì phải thông báo ngay cho người quản lý chương trình của bên A để thống nhất hướng giải quyết
- Không được tự ý hủy bỏ hợp đồng, nếu vi phạm điều này thì bên B phải trả cho bên A một khoản tiền tương đương 100% tổng giá trị hợp đồng
4.2. Bên B có quyền sau đây:
- Nhận được chi phí đầy đủ và đúng thời hạn theo hợp đồng.
- Trong trường hợp Bên A vi phạm nghiêm trọng nghĩa vụ thì Bên B có quyền đơn phương chấm dứt thực hiện hợp đồng và yêu cầu bồi thường thiệt hại.

ĐIỀU 5 : ĐIỀU KHOẢN CHUNG
- Hai bên cam kết sẽ thực hiện Hợp đồng với tất cả thiện chí. Trong quá trình thực hiện Hợp đồng nếu có phát sinh tranh chấp hai bên sẽ cùng nhau thượng lượng giải quyết trên tinh thần hợp tác xây dựng. Nếu tranh chấp không tự giải quyết được sẽ được đưa ra tòa án nhân dân có thẩm quyền để giải quyết.
- Các bên có quyền đơn phương chấm dứt Hợp đồng và yêu cầu bồi thường thiệt hại trong trường hợp Bên còn lại không thực hiện đúng quy định tại Hợp đồng.Trường hợp Bên đơn phương chấm dứt hoặc hủy bỏ Hợp đồng, gây thiệt hại mà không do lỗi của Bên còn lại, thì Bên đơn phương phải chịu trách nhiệm bồi thường 100% giá trị Hợp đồng này đồng thời hoàn trả cho Bên thiệt hại toàn bộ số tiền đã được thanh toán tạm ứng (nếu có). Việc bồi thường này được thực hiện trong 5 ngày kể từ ngày một trong hai bên đơn phương chấm dứt thực hiện Hợp Đồng này.
- Các trường hợp bất khả kháng như do điều kiện thời tiết hoặc do Nhà Nước Việt Nam thay đổi về chính sách liên quan khiến cho biên bản này không thể thực hiện được, hoặc thực hiện được một phần, thì các bên sẽ đàm phán thương thảo trên tinh thần hợp tác. Việc chấm dứt biên bản phải được thể hiện bằng văn bản.
- Trong trường hợp chấm dứt Hợp đồng trước hạn vì bất cứ lý do gì, hai bên có nghĩa vụ tiến hành thanh lý Hợp đồng bằng việc lập Biên bản thanh lý Hợp đồng để xác nhận chấm dứt mọi quyền và nghĩa vụ của mỗi bên quy định tại Hợp đồng này. Ngay cả khi Hợp đồng đã được thanh lý, Bên B phải đảm bảo nghĩa vụ bảo mật thông tin như quy định tại Điều 4.2 của Hợp đồng.
- Sau khi các bên hoàn thành phần nghĩa vụ của mình đối với bên còn lại nếu không phát sinh bất cứ khiếu nại nào thì trong vòng sau 30 (ba mươi) ngày làm việc Hợp đồng này tự động được thanh lý.

ĐIỀU 6: HIỆU LỰC CỦA HỢP ĐỒNG
Hai bên đã xem xét kỹ các điều khoản trong hợp đồng này và đồng ý cùng nhau ký kết.
