Sau khi Đại hội đồng Liên hợp quốc (ĐHĐ LHQ) tiến hành bỏ phiếu bầu chọn các vị trí thành viên của Ủy ban Luật pháp quốc tế (gọi tắt là ILC) hôm 3-11, Đại sứ (ĐS) Việt Nam (VN) tại Kuwait Nguyễn Hồng Thao đã trúng cử với số phiếu 120/191. Đây là lần đầu tiên có người VN tham gia ứng cử và trúng cử tại một diễn đàn pháp lý có uy tín, cơ quan chuyên soạn thảo những công ước quốc tế quan trọng như ILC. Cơ quan này còn nghiên cứu về những vấn đề lớn của luật pháp quốc tế, luật về quan hệ giữa các quốc gia.

Theo PGS.TS Vũ Thanh Ca, Vụ trưởng Vụ Hợp tác Quốc tế và Khoa học Công nghệ (thuộc Tổng cục Biển và Hải đảo VN), việc ĐS Nguyễn Hồng Thao được bầu vào ILC mở ra nhiều cơ hội để VN đấu tranh pháp lý hiệu quả hơn để bảo vệ chủ quyền, các quyền và lợi ích quốc gia của VN trên biển, đảo, đặc biệt là tại hai quần đảo Hoàng Sa và Trường Sa.
Căn cứ vào một số nghị quyết của Đại hội đồng Liên hiệp quốc (ĐHĐ LHQ), ILC có trách nhiệm dự thảo các công ước về những chủ đề chưa được điều chỉnh bởi luật pháp quốc tế hoặc là các chủ đề chưa được điều chỉnh đầy đủ trong thực tiễn áp dụng luật pháp của các nước. Ngoài ra, ILC cũng “pháp điển hóa” luật pháp quốc tế, có nghĩa là quy định chi tiết và hệ thống hóa thành luật pháp quốc tế những vấn đề trong thực tiễn, có tiền lệ hoặc các học thuyết đã được áp dụng rộng rãi tại các nước. Các bản dự thảo sau đó sẽ được trình lên ĐHĐ LHQ để xem xét, thông qua và ban hành.
ILC cũng xem xét các đề xuất, dự thảo công ước đa phương được các nước thành viên LHQ, các Tổ chức chính của LHQ (trừ Đại hội đồng), các cơ quan đặc biệt, các tổ chức chính thức được thành lập theo các thỏa thuận liên chính phủ để thúc đẩy việc phát triển tiến bộ và pháp điển hóa luật pháp quốc tế. Ngoài ra, Ủy ban cũng có nhiệm vụ cung cấp đầy đủ hơn những bằng chứng về luật tập quán quốc tế, thí dụ như Ủy ban cần phải xem xét các cách thức để thu thập và xuất bản những tài liện liên quan đến thực tiễn quốc gia và các quyết định của các tòa án quốc gia, quốc tế về các vấn đề luật pháp quốc tế, sau đó báo cáo lại ĐHĐ LHQ.
Với tư cách là thành viên Ủy ban, ĐS Nguyễn Hồng Thao sẽ có nhiệm vụ thực hiện tất cả các công việc như nêu ở trên. Đặc biệt là ĐS Nguyễn Hồng Thao sẽ có trách nhiệm tổng kết tất cả những thực tiễn, kinh nghiệm, kết quả nghiên cứu, những thuận lợi, khó khăn của VN trong việc thực thi luật pháp quốc tế để phục vụ cho việc phát triển tiến bộ và pháp điển hóa luật pháp quốc tế.
Các công việc này đòi hỏi phải có kiến thức rất sâu rộng về luật pháp quốc tế. Với kinh nghiệm nhiều năm hoạt động trong lĩnh vực này và là một chuyên gia có tiếng tăm trên thế giới về lĩnh vực liên quan, ĐS Nguyễn Hồng Thao sẽ hoàn thành xuất sắc công việc của mình tại Ủy ban.
Việc VN cử ĐS Nguyễn Hồng Thao tham gia ILC lần này là thể hiện mong muốn, quyết tâm của VN trong hội nhập, bao gồm việc tuân thủ và nội luật hóa các quy định của luật pháp quốc tế vào hệ thống pháp luật VN cũng như đóng góp vào sự phát triển tiến bộ của luật pháp quốc tế.
Sự kiện ĐS Nguyễn Hồng Thao được bầu vào ILC lần này là một bằng chứng chứng tỏ sự công nhận của thế giới về vai trò của VN trong việc phát triển tiến bộ và pháp điển hóa luật pháp quốc tế. Ngoài ra, đó cũng cho thấy rằng bạn bè quốc tế đã thừa nhận việc VN kiên định con đường đổi mới, hội nhập.
Cần chú ý là tiêu chuẩn để được bầu làm thành viên ILC là những người có tiếng tăm trên thế giới về luật pháp quốc tế. Do vậy, việc ĐS Nguyễn Hồng Thao được bầu làm thành viên ITC chứng tỏ giới luật gia VN đã có những người đạt tới trình độ đỉnh cao của thế giới về phương diện luật pháp quốc tế.

ĐS Nguyễn Hồng Thao là một chuyên gia về vấn đề luật pháp quốc tế phân định chủ quyền biển, đảo, đã có nhiều công trình được xuất bản bởi những nhà xuất bản nổi tiếng thế giới và đăng tải trên những tạp chí có uy tín cao. Tuy rằng nguyên tắc hoạt động của các thành viên ILC là độc lập với nước chủ nhà (nghĩa là ĐS Nguyễn Hồng Thao không đại diện cho Chính phủ VN – PV) và chỉ tuân theo sự điều hành của ILC; nhưng quá trình hoạt động của các thành viên cung cấp cơ hội tốt nhất để họ học hỏi, nâng cao kiến thức.
Vì vậy, ĐS Nguyễn Hồng Thao sẽ có cơ hội góp phần đào tạo đội ngũ chuyên gia cho VN và trực tiếp tham gia giải quyết những tranh chấp sau này. Ngoài ra, ILC cũng có mối liên hệ rất chặt chẽ với các toà án quốc tế, đặc biệt là Tòa án quốc tế vì công lý (ICJ). ILC thường mời Chủ tịch ICJ trình bày về những hoạt động gần đây của Tòa, những án lệ của Tòa. Các thành viên ILC cũng thường xuyên thảo luận, trao đổi với Tòa để củng cố kiến thức và thống nhất nhận thức.
