1.2. Trong các trường hợp sau đây,

1.2. Trong các trường hợp sau đây, vụ tranh chấp tuy các bên có thoả thuận trọng tài, nhưng thuộc thẩm quyền giải quyết của Toà án nhân dân:

a. Thoả thuận trọng tài vô hiệu theo quy định tại Điều 10 Pháp lệnh;

Khi xem xét thoả thuận trọng tài có vô hiệu hay không cần chú ý một số trường hợp sau đây:

a.1. Đối với trường hợp quy định tại khoản 2 Điều 10 Pháp lệnh về nguyên tắc chung nếu người ký thoả thuận trọng tài không có thẩm quyền ký kết theo quy định của pháp luật thì thoả thuận trọng tài đó vô hiệu. Tuy nhiên, khi phát sinh tranh chấp mà một bên có yêu cầu Toà án giải quyết, thì Toà án yêu cầu người có thẩm quyền ký kết thoả thuận trọng tài cho biết ý kiến bằng văn bản có chấp nhận thoả thuận trọng tài do người không có thẩm quyền ký kết trước đó hay không. Nếu họ chấp nhận thì trong trường hợp này thoả thuận trọng tài không vô hiệu và vụ tranh chấp thuộc thẩm quyền giải quyết của Hội đồng Trọng tài theo thủ tục chung.
