Tổng giá trị thực hiện hàng tháng căn cứ số nhân lực từng thời điểm do Bên A yêu cầu, đáp ứng các nhiệm vụ được xác định tại khoản 1.4 của Điều 1.
Tổng giá trên đã bao gồm thuế VAT 10%, các chi phí như đồng phục cho nhân viên bảo vệ, phương tiện hỗ trợ thực hiện nhiệm vụ và các chi phí cho người lao động theo quy định của Nhà nước (lương, phụ cấp, bảo hiểm…)
- Bên A sẽ căn cứ vào số lượng nhân lực thực tế để thanh toán cho Bên B theo đơn giá hợp đồng này (việc tăng giảm sẽ được thể hiện bằng các văn bản được người có thẩm quyền phê duyệt).
- Các chốt bảo vệ, bố trí nhân lực phải được điều chỉnh, thay đổi theo yêu cầu của Bên A cho phù hợp với tình hình sản xuất của Nhà máy.
- Giá trị thanh toán chi phí bảo vệ hàng tháng điều chỉnh trong các trường hợp sau:
a) Nhà nước thay đổi chính sách: thay đổi tiền lương, thay đổi Chính sách về thuế (trong trường hợp này chỉ được điều chỉnh khi được cấp có thẩm quyền cho phép).
b) Trường hợp bất khả kháng do thiên tai như động đất, bão, lũ lụt, lốc, sóng thần, lở đất, hỏa hoạn, chiến tranh hoặc có nguy cơ xảy ra chiến tranh, các thảm họa khác được xác định là Bất khả kháng. Khi đó hai Bên A-B thương thảo để xác định giá trị Hợp đồng điều chỉnh phù hợp với các quy định pháp luật.
c) Do Bên A yêu cầu tăng cường thêm nhân lực hoặc giảm bớt nhân lực được thể hiện bằng văn bản của người có thẩm quyền Bên A ký.
- Hiệu lực của hợp đồng này là 12 tháng (từ tháng 01 năm 2015 đến tháng 01 năm 2016.
