Thứ ba, việc công nhận và cho thi hành bản án, quyết định của Tòa án nước ngoài trái với nguyên tắc cơ bản của pháp luật Việt Nam (khoản 6 Điều 356).
Theo câu chữ của điều luật thì bản án, quyết định nước ngoài sẽ không được công nhận nếu bản thân hành vi công nhận và cho thi hành là trái với nguyên tắc cơ bản của pháp luật Việt Nam.
Nếu hiểu như thế thì quy định này là thừa bởi vì nếu chỉ xem xét hành vi công nhận và cho thi hành có trái với nguyên tắc của pháp luật Việt Nam hay không thì điểm b khoản 1 Điều 343 Bộ Luật TTDS 2004/2011 đã quy định rõ: Tòa án Việt Nam xem xét công nhận và cho thi hành tại Việt Nam bản án, quyết định dân sự của Tòa án nước ngoài trong các trường hợp: “… Bản án, quyết định dân sự của Tòa án nước ngoài được pháp luật Việt Nam quy định công nhận và cho thi hành”.
Ở đây theo tác giả việc sữ dụng thuật ngữ chưa được chính xác bởi không phải bản thân hành vi công nhận và cho thi hành bản án, quyết định của Tòa án nước ngoài mà là hậu quả của hành vi đó trái với nguyên tắc cơ bản của pháp luật Việt Nam.

Third, the recognition and enforcement of judgments, decisions of foreign courts are contrary to the basic principle of the law of Vietnam (clause 6 To 356).
