Tòa án nhân dân:

Tòa án Nhân dân Tối cao, các Tòa án nhân dân địa phương, các Tòa án quân sự và các Tòa án khác do luật định là những cơ quan xét xử của nước Cộng hòa xã hội chủ nghĩa Việt Nam. Trong tình hình đặc biệt, Quốc hội có thể quyết định thành lập Tòa án đặc biệt. Khi xét xử, Hội thẩm ngang quyền, độc lập với Thẩm phán và chỉ tuân theo pháp luật. Tòa án nhân dân xét xử công khai, trừ trường hợp do luật định. Tòa án nhân dân xét xử tập thể và quyết định theo đa số.

Tòa án Nhân dân Tối cao là cơ quan xét xử cao nhất của nước Cộng hòa xã hội chủ nghĩa Việt Nam. Tòa án Nhân dân Tối cao giám đốc việc xét xử của các Tòa án nhân dân địa phương và các Tòa án quân sự, Tòa án đặc biệt và các tòa án khác, trừ trường hợp Quốc hội có quy định khác khi thành lập Tòa án đó.
