Là việc các bên tiến hành thương lượng giải quyết tranh chấp với sự hỗ trợ của bên thứ ba là hòa giải viên. Kết quả hòa giải phụ thuộc vào thiện chí của các bên tranh chấp và uy tín, kinh nghiệm, kỹ năng của trung gian hòa giải, quyết định cuối cùng của việc giải quyết tranh chấp không phải của trung gian hòa giải mà hoàn toàn phụ thuộc các bên tranh chấp.
