Điều 11. Trách nhiệm mua điện từ các dự án điện gió
1. Bên mua điện có trách nhiệm mua toàn bộ điện năng được sản xuất từ các nhà máy điện gió nối lưới thuộc địa bàn do mình quản lý.
2. Việc mua bán điện được thực hiện thông qua hợp đồng mua bán điện được lập theo Hợp đồng mua bán điện mẫu áp dụng cho các dự án điện gió nối lưới do Bộ Công Thương ban hành. Hợp đồng mua bán điện mẫu có các nội dung chính sau:
a) Thời gian hợp đồng là hai mươi (20) năm kể từ ngày vận hành thương mại. Bên bán điện có thể kéo dài thời gian hợp đồng hoặc ký hợp đồng mới với Bên mua điện theo quy định hiện hành.
b) Giá mua điện cơ sở và nguyên tắc điều chỉnh giá bán điện trong thời gian hợp đồng.
c) Thỏa thuận về đấu nối, đo đếm và vận hành nhà máy điện gió.
d) Thỏa thuận về lập hóa đơn và thanh toán.
Điều 12. Ưu đãi về vốn đầu tư, thuế, phí
1. Huy động vốn đầu tư:
a) Nhà đầu tư được huy động vốn dưới các hình thức pháp luật cho phép từ các tổ chức, cá nhân trong và ngoài nước để đầu tư thực hiện các dự án điện gió.
b) Các dự án điện gió được hưởng các ưu đãi theo quy định hiện hành về tín dụng đầu tư của Nhà nước.
2. Thuế nhập khẩu: dự án điện gió được miễn thuế nhập khẩu đối với hàng hóa nhập khẩu để tạo tài sản cố định của dự án, hàng hóa nhập khẩu là nguyên liệu, vật tư, bán thành phẩm trong nước chưa sản xuất được nhập khẩu để phục vụ sản xuất của dự án theo quy định tại Luật Thuế xuất khẩu, Thuế nhập khẩu và các quy định của pháp luật hiện hành về thuế xuất khẩu, thuế nhập khẩu.
3. Thuế thu nhập doanh nghiệp: thuế suất thuế thu nhập doanh nghiệp, việc miễn, giảm thuế thu nhập doanh nghiệp đối với dự án điện gió được thực hiện như đối với dự án thuộc lĩnh vực đặc biệt ưu đãi đầu tư quy định tại Luật Đầu tư, Luật Thuế thu nhập doanh nghiệp và các văn bản hướng dẫn thi hành Luật Đầu tư, Luật Thuế thu nhập doanh nghiệp.
