Nếu bên B đơn phương hủy bỏ hợp đồn

Nếu bên B đơn phương hủy bỏ hợp đồng hoặc điều chỉnh giảm (hủy bỏ) hạng mục mà không phải do lỗi của bên A thì bên B sẽ mất số tiền đặt cọc. Ngoài ra bên B phải chịu phạt 35% giá trị vật tư hàng hóa mà bên A đã đặt hàng và gia công sản xuất cho bên B. Tuy nhiên tổng số tiền phạt do huỷ và vi phạm hợp đồng không vượt quá tổng chi phí mà bên A đã bỏ ra để nhập và gia công hàng. Số tiền phạt sẽ được bên A tự động cấn trừ từ các khoản thanh toán của bên B và yêu cầu bên B thanh toán nếu cần trừ chưa đủ.
