Về phương thức phân phối: Vé xổ số điện toán theo hình thức tự do chọn số, được phân phối theo các phương thức sau:
-Bán trực tiếp cho khách hàng thông qua thiết bị đầu cuối.
- Thông qua điện thoại cố định và điện thoại di động.
- Thông qua internet.Phương thức phân phối này chỉ được thực hiện sau khi được Bộ Tài chính chấp thuận.
Về địa bàn phát hành vé xổ số tự chọn số điện toán:
- Địa bàn phát hành vé xổ số tự chọn số điện toán thông qua phương thức phân phối thiết bị đầu cuối: Công ty xổ số điện toán lựa chọn một số tỉnh, thành phố trên phạm vi cả nước để triển khai phát hành vé xổ số tự chọn số điện toán theo quy định tại Thông tư này. Địa bàn kinh doanh cụ thể, công ty xổ số điện toán báo cáo Bộ Tài chính phê duyệt trước khi thực hiện.
- Địa bàn phát hành vé xổ số tự chọn số điện toán thông qua điện thoại cố định, điện thoại di động và internet: Công ty xổ số điện toán được kinh doanh trên phạm vi cả nước.
Như vậy, việc in sẵn các cặp số dự thưởng đưa đi bán dạo là không đúng với đặc điểm loại hình xổ số tự chọn điện toán. Hành vi trên đã làm mất quyền tự chọn của người mua vé và không khác gì vé số truyền thống. Điều này đã vi phạm nội dung, phương thức phân phối và địa bàn phát hành vé số tự chọn số điện toán được quy định tại Thông tư 136/2013/TT-BTC ở trên.
Căn cứ theo quy định tại Điều 37, Điều 38 Nghị định 98/2013/NĐ-CP thì hành vi này có thể bị xử lý như sau:
“Phạt tiền từ 10.000.000 đồng đến 20.000.000 đồng đối với hành vi thực hiện phân phối vé xổ số không đúng phương thức được phép phân phối.”.
“Phạt tiền từ 10.000.000 đồng đến 20.000.000 đồng đối với hành vi thực hiện kinh doanh xổ số không đúng địa bàn.”.
Thứ ba, đối với việc Vietlott bán lẻ vé số điện toán với giá 12.000 đồng/tờ (cao hơn mệnh giá ghi trong vé 2.000 đồng/tờ):
Tại Điều 37 Nghị định số 98/2013/NĐ-CP ngày 28/8/2013 của Chính phủ quy định về xử phạt vi phạm hành chính trong lĩnh vực kinh doanh xổ số quy định như sau:
