Thứ hai, về việc một cá nhân không thể tham gia BHXH ở hai bên:

+ Điều 21 Bộ luật lao động hiện hành quy định: Trong trường hợp giao kết hợp đồng lao động với nhiều người sử dụng lao động, việc tham gia bảo hiểm xã hội, bảo hiểm y tế của người lao động được thực hiện theo quy định của Chính phủ.

+ Theo Quyết định số 1111/QĐ-BHXH ngày 25/19/2011của bảo hiểm xã hội Việt Nam v/v ban hành Quy định quản lý thu bảo hiểm xã hội, bảo hiểm y tế, bảo hiểm thất nghiệp về đối tượng tham gia BHXH, BHYT, BHTN thì:
“Người lao động có từ 2 hợp đồng lao động hoặc hợp đồng làm việc trở lên với nhiều đơn vị khác nhau thì đóng BHXH bắt buộc, BHYT, BHTN theo hợp đồng lao động hoặc hợp đồng làm việc có tiền lương, tiền công cao nhất hoặc hợp đồng lao động hoặc hợp đồng làm việc có thời gian dài nhất tại cùng một thời điểm”
 Như vậy một người không thể đồng thời đóng BHXH ở nhiều nơi
