Căn cứ Nghị định số 42/2014/NĐ-CP ngày 14 tháng 5 năm 2014 của Chính phủ về quản lý hoạt động bán hàng đa cấp (sau đây gọi là Nghị định 42);
Căn cứ Thông tư số 24/2014/TT-BCT quy định chi tiết thi hành một số điều của Nghị định 42 ngày 14 tháng 5 năm 2014 của Chính phủ về quản lý hoạt động bán hàng đa cấp (sau đây gọi là Nghị định 42);
Căn cứ Hồ sơ đề nghị cấp giấy chứng nhận đăng ký hoạt động bán hàng đa cấp của Công ty TNHH Thương mại Việt Nam Quốc tế Mưa được Cục quản lý cạnh tranh tiếp nhận ngày 14 tháng 10 năm 2015 (Hồ sơ),
Cục quản lý cạnh tranh đề nghị Công ty bổ sung và sửa đổi Hồ sơ như sau:
1. Sửa đổi bổ sung Chương trình trả thưởng
1.1 Nguyên tắc chung
+ Thống nhất giữa quy định tại Chương trình trả thưởng với quy định tại Quy tắc hoạt động, Mẫu Hợp đồng tham gia bán hàng đa cấp, danh mục hàng hóa;
+ Đối với từng loại hoa hồng, tiền thưởng, quy định rõ: đối tượng được hưởng, điều kiện được hưởng, mức hưởng cụ thể, tính trên điểm thưởng quy đổi hay doanh thu theo tiền Việt Nam đồng, định nghĩa hoặc giải thích cụ thể các thuật ngữ để đảm bảo dễ hiểu và hiểu thống nhất. Đối với các hoa hồng phức tạp cần cho ví dụ minh họa cụ thể
+ Đối với các loại hoa hồng chi trả liên quan đến nhiều tầng/ thế hệ, quy định rõ về: số tầng, vấn đề đồng cấp, cách thức loại trừ để tránh trùng lặp dẫn đến tổng giá trị hoa hồng, tiền thưởng và các lợi ích kinh tế khác vi phạm quy định tại điều 26 nghị định 42.
