Trên cơ sở lý luận của chủ nghĩa Mác - Lênin, tư tưởng Hồ Chí Minh về nhà nước và pháp luật, về mối quan hệ giữa nhà nước và cá nhân, về quyền con người, về nền dân chủ pháp quyền xã hội chủ nghĩa, Luận án vận dụng phương pháp luận triết học biện chứng duy vật làm nền tảng, nghiên cứu các vấn đề lý thuyết, pháp lý và thực tiễn bảo đảm quyền con người của Tòa án một cách khách quan, toàn diện, gắn với những bối cảnh lịch sử phát triển kinh tế - xã hội cụ thể. Ngoài ra, luận án còn sử dụng các phương pháp nghiên cứu cụ thể như: phương pháp phân tích, tổng hợp, thống kê, so sánh... để phân tích và chứng minh các luận điểm khoa học được đưa ra trong luận án.
