Đối với hình thức đầu tư thành lập

Đối với hình thức đầu tư thành lập tổ chức kinh tế có nhiều thay đổi so với Luật Đầu tư 2005, theo đó Luật Đầu tư 2014 trước khi thành lập tổ chức kinh tế, nhà đầu tư nước ngoài phải có dự án đầu tư, thực hiện thủ tục cấp Giấy chứng nhận đăng ký đầu tư (giấy CNĐKĐT) và phải đáp ứng các điều kiện về tỷ lệ sở hữu vốn điều lệ và các điều kiện theo quy định của điều ước quốc tế mà Việt Nam là thành viên của điều ước quốc tế đó (căn cứ Điều 22 Luật Đầu tư 2014).
