- Căn cứ nhu cầu và khả năng của hai bên.

Sau khi bàn bạc , hai bên thống nhất ký hợp đồng cung cấp dịch vụ thuê văn phòng làm đại lý du lịch với các nội dung và điều khoản sau :

ĐIỀU 1 : ĐẶC ĐIỂM TÀI SẢN, MỤC ĐÍCH THUÊ, SỐ NGƯỜI SỬ DỤNG .
- Bên A cho Bên B thuê phòng số 112 tại Khách sạn 36 Trần Phú – Nha Trang
- Mục đích sử dụng phòng : Thuê địa điểm mở văn phòng làm đại lý du lịch.
- Số người được phép sử dụng phòng : 03 người Cụ thể như sau :

ĐIỀU 2 : THỜI GIAN THUÊ, TIỀN THUÊ VÀ PHƯƠNG THỨC THANH TOÁN.

1. Thời gian thuê : - Từ ngày 01/04/2015 đến ngày 01/ 04/2018( 03 năm)
- Mỗi ngày làm việc từ : từ 8h00 đến 21h00

2. Tiền thuê :
- Hai Bên cùng thống nhất giá thuê : 8.000.000 đồng / tháng .
- Bên B thanh toán mỗi năm 01 lần vào các ngày 25/03/2015, ngày 25/03/2016, ngày 25/03/2017 với số tiền 96.000.000đ/năm / lần
(Chín mươi sáu triệu đồng chẵn)
Giá trên đã bao gồm VAT
- Phí điện, nước Bên B thanh toán hàng tháng theo thực tế sử dụng cho Bên A vào ngày cuối của mỗi tháng.

3. Phương thức thanh toán :
- Bên A xuất hóa đơn cho Bên B vào ngày cuối của mỗi tháng.
- Bên B thanh toán bằng tiền mặt hoặc chuyển khoản.

ĐIỀU 3 : TRÁCH NHIỆM CỦA MỖI BÊN

1/ Bên A ( Bên Bung cấp) :
- Bàn giao tài sản cho Bên B trong điều kiện còn tốt.
- Tạo điều kiện cho Bên B được treo bảng hướng dẫn vào văn phòng thể hiện bằng 02 ngôn ngữ Việt-Trung
- Đảm bảo an ninh chung cho khu vực văn phòng cho thuê.
- Cung cấp hoá đơn tài chính dịch vụ thuê văn phòng đúng quy định.

2/ Bên B ( Bên yêu cầu ) :
- Trong quá trình hoạt động văn phòng du lịch, Bên B phải đảm bảo tuân thủ mọi quy định của luật pháp nước cộng hòa xã hội chủ nghĩa Việt Nam quy định.
- Nghiêm cấm các hoạt động ảnh hưởng và liên quan đến chính trị và an ninh của nước cộng hòa xã hội chủ nghĩa Việt Nam dưới mọi hình thức.
- Các hoạt động quảng bá, quảng cáo không ảnh hưởng đến thuần phong mỹ tục của nước cộng hòa xã hội chủ nghĩa Việt Nam quy định .
- Nếu Bên B hoạt động ngoài chức năng và quyền hạn của văn phòng du lịch, sẽ hoàn toàn chịu trách nhiệm theo hiến pháp và pháp luật Việt Nam hiện hành quy định.
- Thực hiện đúng quy định của khách sạn ( giữ gìn vệ sinh chung, tự giữ hành lý, tư trang có
giá trị . …. )
- Tài sản nhận bàn giao nếu hư hỏng trong quá trình sử dụng phải chịu trách nhiệm sửa chữa
hoăïc mua mới.







ĐIỀU 4 : ĐIỀU KHOẢN CHUNG
- Bên nào đơn phương chấm dứt hợp đồng sẽ bị phạt 100% theo tổng giá trị hợp đồng đã ký
- Hai Bên cam kết thực hiện đúng các điều kiện và các điều khoản ghi trong hợp đồng này.
- Trong quá trình thực hiện có điều gì vướng mắc, hai Bên cùng bàn bạc giải quyết. Bất kỳ sự thay đổi nào của một bên đều không có giá trị .
- Tòa án kinh tế Tỉnh Khánh Hòa được hai bên thỏa thuận chọn để giải quyết những bất
đồng nếu có. Sự phán quyết của tòa án kinh tế Tỉnh Khánh Hòa có giá trị cuối cùng. Chi
phí phát sinh trong quá trình tranh chấp sẽ do bên vi phạm chịu.
- Hợp đồng có hiệu lực từ ngày ký đến hết ngày 01/04/2018.
- Hợp đồng được thành lập thành 04 bản , mỗi bên giữ 02 bản có giá trị pháp lý ngang
nhau.
