Trước tiên Công ty TNHH vận tải Tiến Mạnh xin chân thành cám ơn sự hợp tác của Ông và Công ty TNHH xây dựng SEOGWOO (VIỆT NAM) – gọi tắt là Công ty Seogwoo với chúng tôi trong suốt thời gian qua.
Căn cứ vào tình hình thực tế, chúng tôi xin gửi đến Ông kiến nghị như sau:
1. Hiện tại Công ty Seogwoo còn đang nợ tài chính chúng tôi 02 công trình đã hoàn thiện, mặc dù đã đưa vào sử dụng từ rất lâu :
- Công trình Dong Yang ( Thi công hạ tầng) đã bàn giao cho Chủ đầu tư và đưa vào sử dụng từ tháng 6/2015.
- Công trình Haengsung – giai đoạn 1 (Thi công san lấp + Thi công phần hạ tầng) đã được bàn giao và đưa vào sử dụng từ tháng 11/2015.
Phía Công ty Tiến Mạnh chúng tôi cũng mặc dù đã gửi công văn nhiều lần đề nghị Công ty Seogwoo thanh quyết toán, nhưng đến thời điểm hiện tại chúng tôi chưa nhận được bất cứ một văn bản trả lời cụ thể nào về kế hoạch thanh toán cho những tồn đọng tài chính nêu trên.
Ngày 13/8/2016, trong cuộc họp tại Hải Phòng, Ông có hứa với chúng tôi: Tháng 8/2016 sẽ thanh quyết toán công trình Dong Yang và tháng 9/2016 sẽ thanh quyết toán công trình Haengsung; và mong muốn phát triển sự hợp tác giữa 2 Công ty .
Quan trọng hơn nữa việc kéo dài tình trạng trên khiến Công ty chúng tôi phải thanh toán những khoản tài chính phát sinh khác đi kèm (chi phí quản lí bộ máy, lãi suất ngân hàng …)
2. Ngoài 2 công trình nêu trên, các công trình chúng tôi đã ký hợp đồng năm 2016 về việc san lấp với Công ty Seogwoo đều đã san lấp xong, đều chưa được thanh quyết toán:
- Công trình Heesung (giai đoạn 1),
- Công trình Woosung,
- Công trình HKT,
- Công trình SL,
- Công trình Halla,
- Công trình HS,
- Công trình Ilshin.





Kính thưa Ông và Công ty Seogwoo, tại thời điểm Seogwoo cần tiến độ gấp về san lấp cho các công trình, mặc dù chưa kí kết hợp đồng chúng tôi vẫn triển khai và đảm bảo tiến độ theo yêu cầu của Chủ đầu tư và Công ty Ông. Tiến Mạnh luôn đặt uy tín và lợi ích của nhà thầu cũng như uy tín với Chủ đầu tư lên trên hết, nhưng thực tế lòng tin & sự nỗ lực của chúng tôi nhận được kết quả hoàn toàn trái ngược. Cụ thể như chúng tôi được biết phía Seogwoo đã sử dụng nhà cung cấp mới cho dự án đang thi công tại Hải Phòng.
Vì vậy, bằng công văn này chúng tôi đề nghị:
1. Công ty Seogwoo thanh toán ngay cho chúng tôi 2 công trình Dong Yang và Seogwoo (theo như lộ trình đã thống nhất trong cuộc họp trước)
2. Chúng tôi buộc phải tạm dừng các phương tiện, con người ra vào 2 công trình Dong Yang và Haengsung từ ngày 06/9/2016 do đã sử dụng phần đường của Tiến Mạnh thi công nhưng chưa được phía Công ty ông thanh toán cho đến khi nhận được 100% giá trị thanh toán của 2 công trình trên .
3. Tiếp đến Công ty Seogwoo phải sớm có kế hoạch cụ thể về việc thanh quyết toán khối lượng san lấp của các công trình: Heesung (giai đoạn 1), Woosung, HKT, Halla, SL, HS, Ilshin. Nếu đến 15/9/2016 Công ty Seogwoo chưa có kế hoạch cụ thể cho việc thanh quyết toán của các công trình này, chúng tôi buộc phải có biện pháp thu hồi công nợ với các công trình này với sự tham gia của cơ quan Đại diện Pháp luật tại Việt Nam.
Thành thật xin lỗi Ông và Công ty Seogwoo về việc gửi văn bản này đến các nhà thầu phụ khác (là các Công ty Việt Nam) để bảo vệ quyền lợi về kinh tế cũng như sự minh bạch trong kinh doanh.

First Transport Company Limited Tien Manh sincerely thanked the cooperation of Mr. and Co. construction SEOGWOO (VIETNAM) - referred to as the company Seogwoo with us during the past years.
Based on the actual situation, we would like to send and proposed the following:

2. In addition to the above two projects, the works we have signed a contract in 2016 for the company leveled with leveling Seogwoo have done, are yet to be settled:
- Works Heesung (phase 1),
- Woosung works,
- works HKT,
- works SL,
- works Halla,
- works HS,
- works Ilshin.





Dear Mr. and company Seogwoo, at Seogwoo need of reclamation work schedule for works, although not yet signed the contract we have implemented and ensure progress at the request of the investor and the company Mr. Tien Manh always put reputation and interests of the contractors as well as credibility with the investor first, but actually trust & our efforts received completely opposite results. Specifically as we know have used the Seogwoo new suppliers for projects under construction in Haiphong.
So by this dispatch we suggest:
1. Company Seogwoo immediate payment to us 2 Dong Yang and Seogwoo works (according to the roadmap agreed in previous meetings)
2. We had to stop the vehicle, man works out to 2 Dong Yang and the date 06/9/2016 Haengsung used as part of the Tien Manh road construction but not yet paid the company until his after receiving 100% of payment value 2 works on.
3. Next, the company plans to soon Seogwoo must detail the mass settlement of the reclamation works: Heesung (phase 1), Woosung, HKT, Halla, SL, HS, Ilshin. If on 09.15.2016 the Company Seogwoo no specific plans for the settlement of this project, we are forced to take measures for debt collection work with the involvement of agencies Legal representative in Vietnam.
