Trong trường hợp quyền, nghĩa vụ, lợi ích của các bên trong HĐLĐ đã giao kết trước ngày TƯLĐTT có hiệu lực thấp hơn các quy định tương ứng của TƯLĐTT, thì phải thực hiện những quy định tương ứng của TƯLĐTT. Các quy định của NSDLĐ về lao động chưa phù hợp với TƯLĐTT, thì phải được sửa đổi cho phù hợp với TƯLĐTT trong thời hạn mười lăm (15) ngày, kể từ ngày TƯLĐTT có hiệu lực.
