Ngày 18/8/2015, Tổng cục Thuế ban hành công văn số 3346/TCT-CS hướng dẫn về ưu đãi thuế TNDN đối với dự án đầu tư tại khu công nghiệp thành lập theo quyết định của Thủ tướng
Theo đó, tại điểm 55 Phụ lục II ban hành kèm theo Nghị định số 108/2006/NĐ-CP thì "Các khu công nghiệp được thành lập theo Quyết định của Thủ tướng" thuộc Danh mục địa bàn có điều kiện kinh tế xã hội khó khăn. Tuy nhiên, không quy định các khu công nghiệp này phải đồng thời nằm trên địa bàn có điều kiện kinh tế xã hội khó khăn (theo danh mục địa bàn khó khăn từ số thứ tự 1 - 54 Phụ lục II Nghị định số 108/2006/NĐ-CP )
