THCL Vừa qua, báo Thương hiệu và Công luận liên tiếp nhận được đơn kêu cứu của cư dân tại tổ dân phố 21, phường Khương Đình, quận Thanh Xuân phản ánh về việc dự án cải tạo hồ Đầm Chuối và Hạ Đình do Sở Xây dựng Hà Nội làm chủ đầu tư đã gây ảnh hưởng nghiêm trọng đến nhà ở và đời sống của bà con nơi đây.

Tiến độ dự án chậm như “rùa bò”
Theo nội dung đơn phản ánh, được biết dự án cải tạo hồ Đầm Chuối và Hạ Đình (hay còn gọi là hồ 4) được triển khai từ tháng 7/2013 và dự kiến hoàn thành vào tháng 9/2014, do Sở xây dựng Hà Nội làm chủ đầu tư và CIENCO 1 là nhà thầu chính, còn nhà thầu phụ là Liên danh Công ty cổ phần Xây dựng và thương mại Gia Lâm và Công ty cổ phần Đầu tư xây dựng 579, kinh phí thực hiện dự án từ nguồn vốn ODA vay của cơ quan hợp tác quốc tế Nhật Bản (JICA), thuộc địa bàn phường Khương Đình, Thanh Xuân, thành phố Hà Nội.
Tuy nhiên tới nay, sau 2 năm dự án được triển khai, đoạn từ km 0+239,76 ra tới mặt đường Vũ Tông Phan việc lắp đặt hệ thống công thoát nước vẫn chưa được triển khai. Trong khi đó, quá trình thi công phần I (từ khu vực Đầm Chuối tới km 0+239,76) bên nhà thầu thi công đã không đáp ứng được yêu cầu kỹ thuật dẫn đến làm lún, nứt nhà, bể nước sinh hoạt cũng như bể phốt của một số hộ dân có hệ thống cống thoát nước đi qua. Những hộ dân có nhà bị lún, nứt này đều có khoảng không gian cách hệ thống cống thoát nước ngầm ít nhất là 3m.
Theo tìm hiểu của PV, đây là đoạn ngõ hẻm rộng chưa đầy 4m (đoạn hẹp nhất là 3,4m, rộng nhất là 3,8m), hai bên là các hộ dân xây nhà 4-5 tầng có mái hiên rộng từ 0,8 đến 1,2m. Nhưng, theo kế hoạch của chủ đầu tư thì việc thi công vẫn sử dụng hàng loạt máy móc lớn như cần cẩu, máy xúc để thi công. Điều này sẽ rất khó khăn cũng như nguy hiểm tính mạng và như tài sản của các hộ dân hai bên công trình thi công.
Trước thực trạng trên, người dân tại đây đã nhiều lần gửi đơn kiến nghị lên chính quyền cũng như chủ đầu tư, nhà thầu thi công với mong muốn phía chủ đầu tư, nhà thầu thi công bảo đảm thực hiện đúng các quy định của pháp luật để không ảnh hưởng tới nhà ở, đời sống của người dân. Tuy nhiên, chủ đầu tư và nhà thầu vẫn bất chấp sự an toàn, quyết định khoan sâu 7m, cách móng nhà dân 0,4m để đặt hệ thống cống hộp sâu 5- 6m.
“Việc thi công một hệ thống cống ngầm sâu đến 7m như vậy mà đào sát vào móng nhà dân (chỉ cách 0,4m trên bản vẽ), điều này rất nguy hiểm tới kết cấu móng của các ngôi nhà, có nguy cơ sụp đổ đe dọa an toàn cho người dân ” chị Nguyễn Thị Hồng Thịnh (tổ trưởng tổ dân phố 21) bức xúc. Nó có thể ví như chúng tôi sống trên một cái bẫy, nhà có thể nứt, lún, sập bất cứ lúc nào do ảnh hưởng của việc thi công cống không tuân thủ quy chuẩn thi công cống ngầm, tính mạng của chúng tôi bị đe dọa hàng ngày”
“Phớt lờ” ý kiến người dân
Ngày 18-6-2015, phía chủ đầu tư và nhà thầu đã tổ chức buổi họp thông báo về việc thi công hệ thống cống hộp thuộc Gói thầu 6.3- Dự án cải tạo hồ 4 (Đầm Chuối và Hạ Đình). Tại cuộc họp, phía nhà thầu đã trình bày phương án thi công, trong đó nêu rõ cống hộp của dự án với tầm cỡ 1m50 x 1m50, sâu 5-7m, đoạn sâu nhất là 8m, sẽ được hạ đặt trên một ngõ hẻm rộng chưa đầy 4m, hai bên là những nhà xây kiên cố 5 tầng có mái hiên rộng từ 0.8 đến 1.2m. Sau khi nghe trình bày từ phía nhà thầu, chúng tôi đã không chấp thuận với phương án thi công không khả thi về mặt kỹ thuật, không đảm bảo an toàn tính mạng và tài sản cư dân hai bên công trình như vậy. Tuy nhiên, cuộc họp chỉ có sự có mặt của đại diện phường Khương Đình và nhà thầu, không hề có đại diện phía chủ đầu tư và đơn vị bảo hiểm. Đặc biệt, phía nhà thầu chỉ im lặng và không đưa ra được bất kỳ giải trình hay bảo đảm thỏa đáng nào.

Bác Tạ Thị Thanh cho hay: “Nếu thi công, nhà tôi là dễ đổ, sập nhất vì khoảng cách giữa cống thoát nước và nhà tôi chỉ gần 20cm, mà đào sâu đến 8m, thậm chí khi đào xuống sẽ cắt mất một phần móng nhà nữa”.
Dư luận không khỏi băn khoăn, việc thi công hệ thông cống hộp rộng và đào sâu 5-6m sát vào móng nhà dân, lại trên một khu vực chật hẹp rộng chưa đầy 4m có đảm bảo an toàn tính mạng và tài sản cho người dân hay không? Liệu rằng, sau khi công trình hoàn thành, an sinh xã hội của người dân có được đảm bảo không?
Phương án thi công “đã” được phê duyệt ?
Ngày 26/8/2015, người dân tổ 21 phường Khương Đình đã viết thư ngỏ tới công ty JICA về việc hỏi xem phương án thi công khoan cọc nhồi ở đoạn thắt cổ chai đi qua nhà dân đã được Sở xây dựng phê duyệt chưa thì phía công ty JICA cho biết sở chưa phê duyệt. Tuy nhiên, trước đó trong cuộc họp ngày 31/7/2015, ông Đặng Hồng Thái - Phó chủ tịch quận Thanh Xuân có phát biểu với người dân rằng: “Phương án thi công đã được Sở xây dựng phê duyệt và chủ đầu tư cứ thế mà làm”
Không những thế, cũng tại cuộc họp này, ông Nguyễn Đình Hưng - Bí thư phường Khương Đình nói rằng người dân phải làm đúng pháp luật, phải để cho chủ đầu tư và đơn vị thi công tiến hành làm cống. Nhưng khi chúng tôi hỏi lại: Liệu đồng chí có biết là thi công cống ngầm đúng pháp luật là theo tiêu chí khoảng cách an toàn cách xa móng nhà dân là bao nhiêu không? Ông Hưng cho hay: “cái này thuộc về chuyên môn, tôi chưa biết”
Liệu rằng, việc thi công cống ngầm sâu 8m chỉ cách móng nhà dân 0,4m có đúng theo những quy định của pháp luật hiện hành hay không ?
Thiết nghĩ, các cơ quan chức năng liên quan, UBND phường Khương Đình, UBND quận Thanh Xuân, Sở Xây dựng Hà Nội, chủ đầu tư, nhà thầu thi công cần có những biện pháp, phương án để đảm bảo an toàn cho cho các công trình và tính mạng người dân.
Tại mục 16.2.2 quy định vị trí bố trí một số công trình ngầm theo tiêu chuẩn xây dựng Việt Nam: TCXDVN104: 2007 "Đường đô thị – Yêu cầu thiết kế ", ban hành cùng quyết định số 22/2007/QĐ-BXD ngày 30/5/2007 có quy định rõ, khoảng cách giữa mép móng nhà và công trình đến ống thoát nước tối thiểu phải là 3m
